【摘要】： 心理測(cè)試技術(shù),作為一種高科技的刑事偵查手段,已經(jīng)被越來(lái)越多的運(yùn)用到犯罪的偵查過(guò)程中,在刑事訴訟中發(fā)揮著越來(lái)越重要的作用,然而,與世界上其他研究和使用心理測(cè)試技術(shù)的國(guó)家相比,我國(guó)心理測(cè)試的基礎(chǔ)理論的研究還比較滯后,也尚未出臺(tái)關(guān)于規(guī)范心理測(cè)試技術(shù)使用的法律規(guī)則和具體的操作程序,心理測(cè)試結(jié)論的法律地位也沒(méi)有明確,這與我國(guó)刑事司法實(shí)踐中心理測(cè)試技術(shù)的廣泛應(yīng)用的實(shí)際狀況是不相適應(yīng)的,構(gòu)建適合我國(guó)國(guó)情的心理測(cè)試規(guī)范體系,肯定心理測(cè)試結(jié)論的證據(jù)能力和證明能力,已經(jīng)成為立法和司法必須盡快解決的問(wèn)題。 全文共分四個(gè)部分： 第一部分,從心理測(cè)試技術(shù)的概念談起,并從中總結(jié)出心理測(cè)試技術(shù)的四個(gè)特點(diǎn),隨后,又通過(guò)實(shí)測(cè)案例介紹了心理測(cè)試技術(shù)在認(rèn)定和排除嫌疑,保護(hù)無(wú)辜；作為傳統(tǒng)訊問(wèn)方法的補(bǔ)充手段,用于輔助訊問(wèn)；辨析證詞、供詞的真假,解決證據(jù)之間的矛盾；在一定程度上減少刑訊逼供現(xiàn)象的發(fā)生等四個(gè)方面的作用,最后,介紹了心理測(cè)試技術(shù)適用的對(duì)象條件、時(shí)機(jī)條件、設(shè)備及環(huán)境條件。 第二部分,心理測(cè)試技術(shù)在國(guó)外的發(fā)展和現(xiàn)狀。從古代鑒別謊言的方法談起,介紹了心理測(cè)試技術(shù)的產(chǎn)生和發(fā)展歷程,重點(diǎn)介紹了心理測(cè)試技術(shù)在國(guó)外的應(yīng)用。 第三部分,心理測(cè)試技術(shù)在國(guó)內(nèi)的應(yīng)用現(xiàn)狀及存在的問(wèn)題。首先介紹了心理測(cè)試技術(shù)在國(guó)內(nèi)的發(fā)展應(yīng)用現(xiàn)狀,隨后指出了心理測(cè)試技術(shù)在運(yùn)用中存在的問(wèn)題：缺乏適合我國(guó)國(guó)情的測(cè)試?yán)碚�；測(cè)試儀器紛繁復(fù)雜,缺乏統(tǒng)一的技術(shù)標(biāo)準(zhǔn)；測(cè)試人員既不中立又不專業(yè),缺乏專業(yè)機(jī)構(gòu)和統(tǒng)一認(rèn)定；測(cè)試的組織和實(shí)施處于無(wú)序的狀態(tài),缺乏嚴(yán)格的程序性規(guī)定；測(cè)試的結(jié)論仍不能作為訴訟證據(jù)使用,缺乏法律的明確規(guī)定等五個(gè)方面的問(wèn)題。 第四部分,心理測(cè)試在我國(guó)刑事訴訟中應(yīng)用的規(guī)范體系的構(gòu)建。在深入分析存在問(wèn)題的基礎(chǔ)上,著重從四個(gè)方面提出構(gòu)建適合我國(guó)國(guó)情的心理測(cè)試規(guī)范體系,是明確心理測(cè)試結(jié)論的法律地位；二是加強(qiáng)心理測(cè)試技術(shù)的基礎(chǔ)理論的研究；三是確立構(gòu)建心理測(cè)試規(guī)范體系應(yīng)遵循的基本原則；四是統(tǒng)一心理測(cè)試的技術(shù)規(guī)格。
[Abstract]:Psychological testing technology, as a high-tech means of criminal investigation, has been more and more used in the process of criminal investigation, in the criminal proceedings play a more and more important role, however, Compared with other countries in the world that study and use psychological testing technology, the research on the basic theory of psychological testing in our country is still lagging behind, and the legal rules and specific operating procedures for standardizing the use of psychological testing technology have not been issued. The legal status of the conclusion of psychological testing is not clear, which is not suitable to the actual situation of the extensive application of psychological testing technology in the practice of criminal justice in our country. Confirming the evidence and proof ability of psychological test conclusion has become the problem that legislation and judicature must solve as soon as possible. The full text is divided into four parts:. The first part, from the concept of psychological testing technology, and summarizes the four characteristics of psychological testing technology, and then through the actual test cases to introduce the psychological testing technology in the identification and removal of suspicion, to protect the innocent; As the supplementary means of the traditional interrogation method, it is used to assist the interrogation; to distinguish the testimony, the truth and falsehood of the confession, to solve the contradiction between the evidence; to reduce the occurrence of the phenomenon of extorting confessions by torture to a certain extent; finally, The object condition, opportunity condition, equipment and environment condition of psychological test technology are introduced. In the second part, the development and present situation of psychological testing technology in foreign countries are discussed. From the methods of identifying lies in ancient times, the emergence and development course of psychological testing technology is introduced, and the application of psychological testing technology in foreign countries is emphasized. In the third part, the present situation and existing problems of psychological testing technology in China are introduced. Firstly, the development and application of psychological testing technology in China are introduced. Then it points out the problems existing in the application of psychological testing technology: lack of testing theory suitable for the national conditions of our country; numerous and complicated test instruments and lack of unified technical standard; the testers are neither neutral nor professional. Lack of professional organization and unified identification; the organization and implementation of the test in a state of disorder, lack of strict procedural provisions; the conclusion of the test can not be used as evidence of litigation, lack of clear provisions of the law and other five aspects of the problems. Part 4th, the construction of the standard system of psychological testing applied in our country's criminal procedure. On the basis of in-depth analysis of the existing problems, the author puts forward the construction of the psychological test standard system suitable for our country's national conditions from four aspects. It is to make clear the legal status of psychological test conclusion; second, to strengthen the research of basic theory of psychological test technology; third, to establish the basic principles to be followed in the construction of psychological test standard system; fourth, to unify the technical specifications of psychological test.
