【摘要】：隨著我國經(jīng)濟和社會的高速發(fā)展和城市化進程的推進,我國流動人口數(shù)目大量增加,人口的流動性增強。與此同時,我國地區(qū)經(jīng)濟發(fā)展的不平衡、省市間行政管理水平的不平衡等綜合因素,造成在流動人口管理中出現(xiàn)了些許法律問題亟需解決。流動人口法制管理問題已成為我國依法治國戰(zhàn)略進程中的難點和重點,這一問題是否可以合理解決,對我國行政管理體制建設具有重要意義。 本文首先對各個行政部門關于流動人口的概念、特征的認識進行了比較分析,然后對中外制度中對流動人口的規(guī)定進行了研究,然后詳細闡述了我國流動人口法制管理中存在行政部門各自為政、流動人口數(shù)據(jù)的信息建設不足、流動人口合法權益的法律保護缺失及其他立法的相關問題。 針對在流動人口激增的過程中出現(xiàn)的法制管理的問題,筆者提出在完善流動人口管理制度時,首先要堅持平等原則,充分尊重人權;再就是要建立統(tǒng)一全面的法律制度;針對流動人口流入地和流出地的人口信息不一致的情況,提出逐步完善流動人口信息系統(tǒng)的建議,充分保障流動人口的合法權益;最后著重強調了流動人口執(zhí)法監(jiān)督的必要性。 最后,本文針對與流動人口密切相關的暫住證制度、流動人口治安管理信息制度以及計劃生育工作中涉及的相關問題進行了初步探討。流動人口管理的法制化是關系我國社會發(fā)展和社會公平價值體現(xiàn)的重要問題,對建設社會主義和諧社會有重要的推動作用。
[Abstract]:With the rapid development of China's economy and society and the advancement of urbanization, the number of floating population in our country has increased greatly, and the mobility of population has increased. At the same time, the imbalance of regional economic development in our country. The imbalance of administrative level among provinces and cities causes some legal problems to be solved in the management of floating population. The legal management of floating population has become a difficult and important point in the strategic process of governing the country by law. Whether this problem can be reasonably solved is of great significance to the construction of administrative system in our country. Firstly, this paper makes a comparative analysis of the concepts and characteristics of the floating population in various administrative departments, and then studies the regulations on the floating population in the Chinese and foreign systems. Then, the author expounds in detail that there are administrative departments in the legal management of floating population in our country, the information construction of floating population data is insufficient, the legal protection of the legal rights and interests of floating population is lacking, and other related problems of legislation are also discussed. In view of the problem of legal management in the process of floating population surge, the author proposes that in perfecting the floating population management system, we should first adhere to the principle of equality, fully respect human rights, and then establish a unified and comprehensive legal system. In view of the inconsistency of population information between the floating population and the outflow place, the paper puts forward the suggestion of perfecting the floating population information system step by step to fully protect the legal rights and interests of the floating population, and emphasizes the necessity of the law enforcement supervision of the floating population. Finally, this paper aims at the temporary residence permit system, which is closely related to the floating population. The public security management information system of floating population and the related problems involved in family planning work are discussed preliminarily. The legalization of floating population management is an important issue related to the social development and the value of social equity in our country. It plays an important role in promoting the construction of a harmonious socialist society.
