【摘要】：勞教制度的廢止有其特定的時代背景,具有鮮明的法治意義。這不代表其毫無價值可言,應篩選、利用好勞教制度的遺產(chǎn),尤其是管理經(jīng)驗和場所、人力等資源。勞教制度廢止后,畢竟產(chǎn)生了一定的制度空隙,需要相關(guān)制度的修正和跟進。諸如強制禁戒、收容教養(yǎng)等專項矯治方法,應利用勞教廢止的機會得到進一步完善。像社區(qū)矯正這種性質(zhì)不同的制度,也需要積極發(fā)揮作用。通過刑事處罰和治安管理處罰的良好銜接,構(gòu)建起統(tǒng)一的違法犯罪矯治體系。在整個過程中,應遵循法治和人權(quán)觀念,完善程序設(shè)計,嚴格限制行政和司法權(quán)力,杜絕"類勞教"現(xiàn)象的出現(xiàn)。
[Abstract]:The abolition of the system of re-education through labour has its specific background and distinct significance of the rule of law. This does not mean that it has no value at all. The legacy of the system of re-education through labour, especially its management experience and place, should be screened and utilized. Manpower and other resources. After the abolition of the re-education through labour system, after all, there has been a certain gap in the system, which needs to be amended and followed up by the relevant systems. For example, special correction methods such as compulsory prohibition and reeducation are required. The abolition of re-education through labour should be used as an opportunity to be further improved. Systems of a different nature, such as community correction, also need to play an active role... Through a good link between criminal penalties and public security management penalties, In the whole process, we should follow the concept of rule of law and human rights, perfect the procedure design, strictly restrict the administrative and judicial power, and put an end to the phenomenon of "quasi-reeducation through labor".
