【摘要】：隨著我國經(jīng)濟的迅猛發(fā)展和社會轉(zhuǎn)型,加快推進戶籍制度改革已成為社會各界的普遍共識。為了全面加快推進戶籍制度改革,2014年7月國務(wù)院頒布實施《關(guān)于進一步推進戶籍制度改革的意見》,開始了新一輪戶籍制度改革。河南省緊緊跟隨國家政策,于同年11月出臺了《河南省人民政府關(guān)于深化戶籍制度改革的實施意見》,成為河南省現(xiàn)行的戶籍改革制度。《實施意見》的貫徹落實,促進了城鎮(zhèn)化進程,產(chǎn)業(yè)結(jié)構(gòu)得到進一步優(yōu)化,人民生活和社會福利水平得到進一步提高,河南省戶籍制度改革向前推進了一大步,但是仍沒有邁出實質(zhì)性的一步,還遠遠沒有“突破利益固化的藩籬”。本文從政府建設(shè)角度出發(fā),嘗試運用城鎮(zhèn)化理論以及社會流動和社會融合理論,對河南省現(xiàn)行戶籍制度進行研究,深入分析其中存在的問題,發(fā)現(xiàn)《河南省人民政府關(guān)于深化戶籍制度改革的實施意見》及其后續(xù)出臺的一系列相關(guān)制度還不完善,存在各地市缺乏階段性改革目標(biāo)、戶籍改革制度缺乏可操作性、缺乏吸引力、居住證制度有待進一步完善、缺乏統(tǒng)一性、偏向優(yōu)勢群體等問題。借鑒其他省市地區(qū)的改革經(jīng)驗,結(jié)合河南省經(jīng)濟結(jié)構(gòu)、人口狀況等實際情況,以公平、平等為原則,對河南省戶籍改革制度提出對策建議:一是督促各地方政府根據(jù)本地社會發(fā)展水平和城市綜合承載力,科學(xué)制定符合本地實際的階段性目標(biāo)、任務(wù)和措施。二是與戶籍相關(guān)的各項法律規(guī)章、經(jīng)濟政策、社會保障體系等都必須制定出具體的實施細則,且要簡單明晰、便于基層人員操作。三是完善戶籍制度各相關(guān)配套制度,確保其在新的城市環(huán)境中能夠立足,能夠享有平等的公共利益和服務(wù)。四是完善居住證實施辦法。五是建立省級統(tǒng)籌的社會福利保障制度,使在人口遷移、自由流動過程中,確保其應(yīng)有的權(quán)益不滅失。六是以事實為依據(jù),以法律為根本,確保進城務(wù)工人員合法權(quán)益。
[Abstract]:With the rapid economic development and social transformation in China, Speeding up the reform of the household registration system has become a general consensus of all walks of life. In order to speed up the reform of the household registration system in an all-round way, the State Council promulgated and implemented "opinions on further promoting the Reform of the Household Registration system" in July 2014, which began a new one. A round of household registration reform. Henan Province closely follows the state policy, In November of the same year, the "opinions of the people's Government of Henan Province on the deepening of the Reform of the Household Registration system" was issued, which became the current household registration reform system in Henan Province. The implementation of the "opinions on implementation" promoted the process of urbanization. The industrial structure has been further optimized, the level of people's living and social welfare has been further improved, and the reform of the household registration system in Henan Province has advanced a big step forward, but it has not yet taken a substantial step forward. From the angle of government construction, this paper tries to use the theory of urbanization, social mobility and social integration to study the current household registration system in Henan Province. Through in-depth analysis of the existing problems, it is found that the opinions of the Henan Provincial people's Government on the implementation of deepening the reform of the household registration system and a series of related systems introduced subsequently are not perfect, and that there is a lack of phased reform objectives in various prefectures and cities. The system of household registration reform lacks maneuverability and attraction, and the residence permit system needs to be further improved, lacking uniformity, favoring superior groups, etc. The reform experience of other provinces and cities is used for reference and combined with the economic structure of Henan Province. On the basis of the principles of fairness and equality, the population situation and other actual conditions, the paper puts forward countermeasures and suggestions for the reform of the household registration system in Henan: first, it urges the local governments to take into account the local social development level and the comprehensive bearing capacity of the cities. Scientific formulation of phased goals, tasks and measures in line with local realities. Second, all laws and regulations related to household registration, economic policies, social security systems, etc., must be formulated with specific implementation rules and regulations, and should be simple and clear. It is convenient for grass-roots personnel to operate. Third, to improve the relevant supporting systems of the household registration system to ensure that they can be established in the new urban environment. To be able to enjoy equal public interests and services. Fourth, to improve the implementation of residence permits. Fifthly, to establish a comprehensive social welfare security system at the provincial level, so that during the process of population migration and free movement, The sixth is based on facts and laws to ensure the legitimate rights and interests of migrant workers.
