【摘要】： 農(nóng)村黑惡勢力犯罪是一種社會根源深、涉及面廣的社會問題。新中國成立后,我國農(nóng)村實行政社合一的管理體制,廣大農(nóng)民群眾在高度集中、統(tǒng)一的計劃經(jīng)濟和社會結構的嚴格控制下,被牢牢地束縛在傳統(tǒng)的、靜態(tài)的、貧窮的農(nóng)村社區(qū),農(nóng)村黑惡勢力賴以生存和演化的社會基礎和外部環(huán)境條件基本被消除。但自改革開放以來,伴隨農(nóng)村社會的轉(zhuǎn)型,農(nóng)村黑惡勢力犯罪大量滋生,它們或以宗族、家族為紐帶,以舊社會的封建行幫和宗族勢力為模式拉幫結派,或以當?shù)貎蓜卺尫湃藛T、地痞惡棍等為主糾集形成犯罪團伙,威脅人民群眾的生命財產(chǎn)安全,破壞農(nóng)村社會經(jīng)濟發(fā)展,腐蝕農(nóng)村青少年和基層干部隊伍,阻礙農(nóng)村精神文明和法制建設,嚴重危害農(nóng)村社會治安和社會穩(wěn)定。 犯罪社會學認為,任何犯罪都是犯罪者的生理狀態(tài)、其所處的自然條件和其出生、生活或工作于其中的社會環(huán)境三種因素相互作用的結果。農(nóng)村黑惡勢力滋生的社會背景是改革開放以來農(nóng)村社會的轉(zhuǎn)型,農(nóng)村社會結構的變遷引起農(nóng)村社會政治、經(jīng)濟、觀念等領域的巨大變化。農(nóng)村基層政治組織功能退化導致權力真空,不良社會團體滋生,經(jīng)濟的變革則引起不同社會群體間的利益沖突,而社會價值觀念的多元化使得原有的思想觀念失去對農(nóng)村社會的有效控制作用,不良犯罪亞文化開始形成。這些因素對農(nóng)村黑惡勢力犯罪的產(chǎn)生均有影響。本文從農(nóng)村社會轉(zhuǎn)型這一角度,運用社會學與犯罪學的相關理論對這一犯罪現(xiàn)象予以分析,通過對農(nóng)村黑惡勢力犯罪的概念及特征的研究和探討,對于正確認識農(nóng)村黑惡勢力犯罪現(xiàn)象發(fā)生、發(fā)展及其活動的內(nèi)在規(guī)律,有的放矢地采取切實有力的措施,有效預防、遏制和打擊農(nóng)村黑惡勢力犯罪,維護廣大農(nóng)村地區(qū)的社會穩(wěn)定,促進農(nóng)村改革的深化和社會經(jīng)濟的發(fā)展,具有十分重要的意義。本文分三個部分進行論述:第一部分,界定農(nóng)村黑惡勢力犯罪,分析其基本特征;第二部分,從社會轉(zhuǎn)型的角度對農(nóng)村黑惡勢力犯罪的成因予以分析;最后,針對農(nóng)村社會結構的變遷,提出控制農(nóng)村黑惡勢力犯罪的相應措施。
[Abstract]:The crime of the criminal and evil forces in rural areas is a social problem with deep social roots and a wide range of aspects. After the founding of New China, the rural areas of our country implemented a management system of integrating government and society, and the broad masses of peasants were highly concentrated. The unified planned economy and the strict control of the social structure are firmly tied to traditional, static, poor rural communities, The social foundation and external environmental conditions on which the rural black and evil forces depend for their survival and evolution have been basically eliminated. However, since the reform and opening up, with the transformation of rural society, a large number of criminal activities of the rural black and evil forces have grown up, and they have been linked by clans and families. In the old society, the feudal gangs and clan forces were used as the model to pull together the gangs, or the two local workers were released, and the local ruffians and villains were mainly gathered to form criminal gangs, which threatened the lives and property of the people and undermined the social and economic development of the rural areas. It corrupts the ranks of young people and grassroots cadres in rural areas, hinders the construction of spiritual civilization and legal system in rural areas, and seriously endangers social order and social stability in rural areas. The sociology of crime holds that any crime is the physiological state of the offender, its natural condition and its birth, The social background of rural black and evil forces is the transformation of rural society since the reform and opening up, the change of rural social structure leads to rural social politics and economy. The degradation of the function of rural grassroots political organizations leads to the vacuum of power, the breeding of bad social groups, and the conflicts of interests between different social groups caused by economic changes. And the diversity of social values makes the original ideas lose their effective control over the rural society. The subculture of bad crimes is beginning to form. These factors have an impact on the emergence of criminal activities in rural areas. From the perspective of social transformation in rural areas, this paper analyzes this criminal phenomenon by using the relevant theories of sociology and criminology. Through the study and discussion of the concept and characteristics of the criminal activities of the rural black and evil forces, to correctly understand the inherent law of the occurrence, development and activities of the criminal phenomena of the rural criminal and evil forces, we should take effective and effective measures to prevent them. It is of great significance to contain and crack down on the crime of the evil forces in the countryside, to maintain the social stability in the vast rural areas, to promote the deepening of the rural reform and the development of the social economy. Define the crime of rural evil forces, analyze its basic characteristics; the second part, from the perspective of social transformation to analyze the causes of crime of rural black and evil forces; finally, in view of the changes of rural social structure, Put forward the corresponding measures to control the crime of the evil forces in the countryside.
