【摘要】："派出所"一詞源自日語,本意指派出的分支機(jī)構(gòu),任何機(jī)構(gòu)都可以有派出所。該詞在中國演變成專指公安機(jī)關(guān)的派出機(jī)構(gòu),新中國從1950年起正式使用派出所稱謂,延續(xù)至今。公安派出所是市、縣公安機(jī)關(guān)直接領(lǐng)導(dǎo)的派出機(jī)構(gòu),是公安機(jī)關(guān)打擊違法犯罪、維護(hù)社會治安、服務(wù)人民群眾、保衛(wèi)一方平安的基層綜合性戰(zhàn)斗實(shí)體。"上面千條線,下面一根針",這句耳熟能詳?shù)脑捿^為形象地說明了派出所在整個公安機(jī)關(guān)中的地位和作用。在實(shí)踐中,派出所履行著法定職責(zé)的同時,又履行著非法定職責(zé),如調(diào)解非治安糾紛及公共服務(wù)等。究竟派出所應(yīng)當(dāng)進(jìn)行何種定位?派出所履行法定職責(zé)中的工作負(fù)荷怎么樣?派出所是否應(yīng)當(dāng)履行非法定職責(zé)?調(diào)解非治安糾紛及公共服務(wù)等職責(zé)是否應(yīng)當(dāng)進(jìn)行明確和細(xì)化?本文將采用文獻(xiàn)研究法、田野調(diào)查法、實(shí)證分析法,采用夾敘夾議的寫作方式對派出所在實(shí)踐中的運(yùn)轉(zhuǎn)現(xiàn)狀進(jìn)行最大限度的真實(shí)呈現(xiàn),并著力從法定職責(zé)的履行、非治安糾紛的調(diào)解及公共服務(wù)的提供三個方面對派出所現(xiàn)狀進(jìn)行描述與分析。本文認(rèn)為,當(dāng)前派出所工作職責(zé)不清,界限不明,無論警情是否屬于法定職責(zé),民警不挑不揀,沒日沒夜地解決問題,造成派出所超負(fù)荷運(yùn)轉(zhuǎn)。對此,我們首先應(yīng)當(dāng)厘清派出所定位,明確并細(xì)化派出所法定職責(zé),增加派出所警力,提高派出所工作效率,保證派出所法定職責(zé)的履行;其次,充分發(fā)揮并拓展派出所的調(diào)解職責(zé),充分發(fā)揮派出所在非治安糾紛中化解矛盾中的作用,創(chuàng)新社會治安綜合治理,構(gòu)建和諧穩(wěn)定的社會秩序;最后,明確并細(xì)化派出所的公共服務(wù)職責(zé),充分發(fā)揮派出所的制度資源優(yōu)勢,使派出所成為社會公共服務(wù)的"引導(dǎo)員",形成政府、市場和非政府組織共同提供公共服務(wù)的局面。
[Abstract]:The term "police station" is derived from Japanese and is intended to refer to the branch of the police station. Any organization can have a police station. The term has evolved into a special public security agency in China. Since 1950, the term "police station" has been officially used in New China. Until now, the public security police station is a grass-roots comprehensive combat entity under the direct leadership of the city and county public security organs. It is a grass-roots comprehensive combat entity with the public security organs to crack down on illegal crimes, maintain public order, serve the people, and safeguard the peace of one square. "there are thousands of lines above. The following needle ", which is familiar to the ear, illustrates more vividly the position and role of the police station in the whole public security organ. In practice, the police station performs both statutory and non-statutory duties. Such as mediation of non-security disputes and public services. What kind of positioning should police stations carry out? What is the workload of the police station in performing its statutory duties? Should the police station perform non-statutory duties? Should the responsibilities of non-public security disputes and public service be clarified and refined? This article will adopt the literature research method, the field investigation method, the demonstration analysis method, uses the narration to discuss the writing way to carry on the biggest real appearance to the police station in the practice present situation, and from the legal duty fulfillment, The present situation of police stations is described and analyzed in three aspects: mediation of non-public security disputes and provision of public services. This paper holds that the duties of police stations at present are not clear and the boundaries are not clear. No matter whether police cases belong to legal duties or not, the police are not selective. Solve the problem day and night, causing the police station to be overloaded. First of all, we should clarify the location of the police station, clarify and refine the statutory duties of the police station, increase the police force, and improve the work efficiency of the police station. To ensure the implementation of the statutory duties of the police stations; secondly, to give full play to the mediation duties of the police stations, to give full play to the role of the police stations in resolving conflicts in non-public security disputes, and to innovate the comprehensive management of public security, Finally, make clear and refine the public service duty of the police station, give full play to the advantage of the system resources of the police station, make the police station become the "leader" of the social public service, form the government, The situation in which markets and NGOs work together to provide public services.
