【摘要】：他們的世界是安靜的,因為他們聽不到來自萬千世界的律動與聲音;他們的世界也是喧囂的,因為在看似平靜的表面之下經(jīng)常是暗潮涌動。聾啞人系屬于殘疾人之列,他們在社會中均為弱勢群體。他們由于自身固有的聽力及語言溝通能力的缺失導(dǎo)致參與各項社會實踐活動受阻;理想的經(jīng)濟利益在工作生活中難以獲得并得到保障;受溝通載體的限制,對外界事物的認知存在明顯的缺陷;社會的歧視性對待在他們心中產(chǎn)生的負面甚至于仇恨的情緒;沒有能力對自我情感進行管理和調(diào)節(jié)等等一系列因素,均使聾啞人在進入社會生活初期難以融入并偏離正常的人生軌跡。司法實踐中,涉及犯罪的聾啞人并不鮮見,迫使社會對于這一特殊群體的成長軌跡進行剖析和思考。首先,本文通過近年來芝罘區(qū)檢察院承辦聾啞人犯罪案件的相關(guān)數(shù)據(jù),提出了當前聾啞人犯罪的形勢的嚴峻性,并對涉及聾啞人犯罪刑罰規(guī)定的國內(nèi)立法淵源和國外立法規(guī)定進行了梳理和列舉。后通過分析總結(jié)聾啞人這類特殊群體的思想認識特點和性格特點,進一步歸納了對于因前述因素導(dǎo)致的聾啞人犯罪的典型特點。其次,結(jié)合特拉維斯.赫希的社會控制理論,探索聾啞人犯罪原因,發(fā)現(xiàn)聾啞人犯罪中家庭、社會等關(guān)愛的缺失是導(dǎo)致聾啞人犯罪的原因之重要方面,同時,社會在聾啞人的教育方面資源分配的不均衡、就業(yè)政策性支持不足以及外界誘惑等原因亦是誘發(fā)聾啞人犯罪的深層次原因。最后,深入淺出的闡述了在辦理聾啞人犯罪案件過程中,在審查、審判、判后羈押等環(huán)節(jié)的司法應(yīng)對措施。從社會角度提出了全社會對聾啞人犯罪預(yù)防的策略性建議,以求從根本上減少聾啞人犯罪的社會誘因,做到標本兼治,切實減少維護社會的公平正義。
[Abstract]:Their world is quiet because they can't hear the rhythms and sounds from thousands of worlds, and their world is noisy, because there is often a dark tide under the seemingly calm surface. The deaf are among the disabled. They are all disadvantaged groups in society. They are hindered to participate in various social practice activities because of their inherent lack of listening and language communication ability, and the ideal economic benefits are difficult to obtain and be guaranteed in their working life. Limited by the carrier of communication, there are obvious defects in the cognition of the external things; the negative and even hate feelings in their hearts are caused by the discriminatory treatment of society; the inability to manage and regulate the self-emotion, and so on. In judicial practice, deaf-mutes involved in crime are not uncommon, forcing the society to analyze and think about the growth trajectory of this special group. Based on the relevant data of the deaf-mute crime cases undertaken by the Zhifu district procuratorate in recent years, this paper points out the seriousness of the current situation of deaf-mute crimes. And the domestic legislative origin and foreign legislative provisions concerning the criminal penalty provisions of deaf mutes are combed and enumerated. After analyzing and summing up the ideological and cognitive characteristics and personality characteristics of such special groups as deaf mutes, Secondly, combined with Travis Hersh's theory of social control, it explores the causes of deaf-mute crime and finds out the family in the crime of deaf mute. The lack of social care is an important factor leading to the crime of deaf and mute people. At the same time, the distribution of resources in the education of deaf and mute people in society is not balanced. The lack of support for employment policy and the temptation of the outside world are also the deep-seated reasons for inducing deaf and mute persons to commit crimes. Finally, in the course of handling the crime cases of deaf and mute persons, the author expounds that in the course of handling the crime cases of deaf and mute persons, they are in the process of examination and trial. In order to reduce the social inducement of deaf-mute crime and to treat it at both the root and the root of the crime, this paper puts forward the strategic suggestions of the whole society for the prevention of crimes committed by the deaf and mute from the social point of view.
