【摘要】：我國進(jìn)入社會轉(zhuǎn)型期以后,群體性事件不斷發(fā)生,其原因紛繁復(fù)雜,在應(yīng)對上出現(xiàn)了處理不當(dāng)而惡化成集群犯罪的例子,給社會造成極其惡劣的影響,危害性極大。在這樣的社會背景下,本文首先通過分析集群事件走向集群犯罪的過程,概括提煉集群犯罪的幾個特征:從心理成因看,組成群體后,個體會無意識地貼上群體標(biāo)簽;在相互暗示中形成群體心理,共同遵守群體規(guī)范;期待性地相信自己愿意相信的信息,讓謠言有市場,讓主體無理智,讓行為變瘋狂;另外,在群體性事件中,個體表現(xiàn)出了異于日常的行為方式,變得情緒化,容易沖動;在群體內(nèi)部的合作欲望也變得更強(qiáng),更容易受身邊人的影響。然后筆者嘗試用榮格的集體無意識理論來分析集群犯罪的心理成因,提出集群犯罪的原型概念。分析集群犯罪的心理成因,探析其原型,就是看在某族群生活的歷史長河中所留下的烙印,使其所具有一整套適應(yīng)環(huán)境和社會的心理生存機(jī)制。我們能看到,宗法制、人治思想依然對集群性事件中的主體起著非常大的作用,人的社會性和動物性交織得到了體現(xiàn)。最后,在分析集群犯罪成因的基礎(chǔ)上,本論文進(jìn)一步提出相應(yīng)的預(yù)防措施:加強(qiáng)法治,信仰法律,以破除宗法制和人治思想藩籬;讓民意有表達(dá)的暢通渠道,及時化解不平情緒,才不至于走向群體性事件乃至集群犯罪的極端方式;切斷謠言傳播途徑,及時發(fā)布真相,對造謠者以不同層次的法律分別施治。
[Abstract]:After our country enters the social transition period, the group incident occurs unceasingly, its reason is numerous and complex, appeared in the response has been handled improperly and degenerated into the cluster crime example, has caused the extremely bad influence to the society, In such a social background, this paper firstly analyzes the process of cluster crime, summarizes the characteristics of cluster crime: from the psychological perspective, after forming a group, Individuals will unconsciously label groups; form group psychology in mutual cues and follow group norms; expect to believe what they are willing to believe, market rumors, make subjects irrational, and make behavior crazy. In group events, individuals behave differently from their daily behavior, become emotional and impulsive, and have a stronger desire to cooperate within the group. Then the author tries to use Jung's collective unconscious theory to analyze the psychological causes of cluster crime, put forward the prototype concept of cluster crime, analyze the psychological causes of cluster crime, and analyze its prototype. It is to look at the imprint left in the long history of the life of a certain ethnic group, so that it has a whole set of psychological survival mechanisms adapted to the environment and society. As we can see, the patriarchal system, The thought of rule by man still plays a very important role in the subject of cluster events, and the interweaving of human sociality and animality is embodied. Finally, on the basis of analyzing the causes of cluster crime, This paper further puts forward the corresponding preventive measures: strengthening the rule of law, believing in the law, breaking down the barriers between the patriarchal system and the thought of ruling by man, allowing public opinion to be expressed through unimpeded channels, and resolving the grievances in a timely manner. In order to avoid going to the extreme ways of mass incidents and even collective crimes, cut off the way of spreading rumors, release the truth in time, and deal with the creators with different levels of law respectively.
