【摘要】： 犯罪心理痕跡是犯罪嫌疑人在實(shí)施犯罪行為的過(guò)程中,受到臨場(chǎng)環(huán)境的影響,有意、無(wú)意地通過(guò)其行為、語(yǔ)言、神態(tài)及其他狀態(tài)特征,作用于侵害體或周圍環(huán)境的反映犯罪人心理活動(dòng)特征的總和。與傳統(tǒng)勘查破案的手段不同,犯罪心理痕跡概念的引入,使犯罪現(xiàn)場(chǎng)的痕跡種類從物質(zhì)痕跡擴(kuò)充到意識(shí)即心理痕跡,并在偵查活動(dòng)中植入心理學(xué)的相關(guān)理論,不僅擴(kuò)大了犯罪信息的范圍,也拓展了偵查人員的偵查視野,為偵查活動(dòng)注入了新鮮的血液,從而為現(xiàn)場(chǎng)勘查行為提供便利和捷徑,引導(dǎo)偵查活動(dòng)走向更廣闊的領(lǐng)域,解決某些偵查困境。對(duì)于整個(gè)偵查過(guò)程來(lái)說(shuō),犯罪心理痕跡分析技術(shù)能夠?qū)崿F(xiàn)傳統(tǒng)偵查手段所不及的偵查效果,對(duì)于偵查活動(dòng)的意義重大。 本文有四個(gè)章節(jié),第一章介紹犯罪心理痕跡的一些相關(guān)問(wèn)題,其中包括犯罪心理痕跡的概念、特征、基本原理及利用價(jià)值,引出犯罪心理痕跡的重要性和實(shí)用性,并提出其對(duì)于刑事現(xiàn)場(chǎng)勘查和整個(gè)偵查活動(dòng)及預(yù)防犯罪方面的效用;第二章介紹犯罪心理痕跡分析的基本問(wèn)題,包括犯罪心理痕跡分析的概念、依據(jù)、方法、步驟及與傳統(tǒng)勘查行為相比,犯罪心理痕跡分析的獨(dú)到性和必要性,使犯罪心理痕跡在刑事現(xiàn)場(chǎng)勘查中的運(yùn)用成為可能;第三章從犯罪以及犯罪狀態(tài)的各個(gè)角度研究犯罪心理痕跡分析在每一角度如何運(yùn)用及所能體現(xiàn)的價(jià)值和意義以及在現(xiàn)場(chǎng)勘查中運(yùn)用犯罪心理痕跡分析應(yīng)當(dāng)注意的問(wèn)題,并簡(jiǎn)略概括犯罪心理痕跡分析技術(shù)在目前在我國(guó)理論和實(shí)踐中的現(xiàn)狀及發(fā)展?fàn)顩r,提出筆者對(duì)相關(guān)問(wèn)題的看法和建議;第四章總結(jié)現(xiàn)場(chǎng)勘查中犯罪心理痕跡分析可能遇到的難點(diǎn)和困境及提出解決方案,引出當(dāng)前任務(wù):不斷完善犯罪心理痕跡的相關(guān)理論研究,從而指導(dǎo)實(shí)踐,并科學(xué)運(yùn)用犯罪心理痕跡分析的各種方法,總結(jié)經(jīng)驗(yàn)教訓(xùn),注重發(fā)揮犯罪心理痕跡分析在現(xiàn)場(chǎng)勘查中的積極作用。 本文的重點(diǎn)章節(jié)為第三章,是文章分析的重點(diǎn)同樣也是論文的論點(diǎn),由十節(jié)組成,從不同角度全方位論證筆者的論點(diǎn),論據(jù)充分,論點(diǎn)鮮明。全文四個(gè)章節(jié)環(huán)環(huán)相扣,邏輯順序井然,全文采取對(duì)比論證和舉例論證等論證方法,以加強(qiáng)論據(jù)的說(shuō)服力和使用價(jià)值。從犯罪心理痕跡的基本概念入手切入到科學(xué)合理地進(jìn)行犯罪心理痕跡的分析,進(jìn)一步把對(duì)犯罪心理痕跡的分析引入到現(xiàn)場(chǎng)勘查的各個(gè)角度,從實(shí)戰(zhàn)角度研究犯罪心理痕跡分析在現(xiàn)場(chǎng)勘查中如何運(yùn)用及能夠產(chǎn)生什么樣的價(jià)值,最后概括犯罪心理痕跡分析在現(xiàn)場(chǎng)勘查運(yùn)用中應(yīng)注意的問(wèn)題和所遇到的難點(diǎn),并對(duì)我國(guó)開(kāi)展的情況進(jìn)行概括和展望。
[Abstract]:The criminal psychological trace is that the criminal suspect is affected by the scene environment in the course of carrying out the criminal act, intentionally or unintentionally through his behavior, language, manner and other state characteristics, The summation of psychological activities of criminals acting on the body or surrounding environment. Different from the traditional methods of investigation and detection, the concept of criminal psychological trace is introduced. It not only expands the scope of criminal information, but also expands the investigation vision of investigators by expanding the kind of trace of crime scene from material trace to consciousness, that is, psychological trace, and embedding the relevant theory of psychology in the investigation activities. It has injected fresh blood into the investigation activities, thus providing convenience and shortcut for the on-the-spot investigation, guiding the investigation activities to a wider field, solving some investigative difficulties. For the whole investigation process, The criminal psychological trace analysis technology can realize the investigation effect which the traditional investigation means is not, and has great significance to the investigation activity. There are four chapters in this paper. The first chapter introduces some related problems of the criminal psychological trace, including the concept, characteristics, basic principle and utilization value of the criminal psychological trace, which leads to the importance and practicability of the criminal psychological trace. The second chapter introduces the basic problems of criminal psychological trace analysis, including the concept, basis and method of criminal psychological trace analysis. Compared with the traditional exploration behavior, the unique and necessity of the criminal psychological trace analysis makes it possible to use the criminal psychological trace in the criminal scene investigation. The third chapter studies how to use and embody the value and significance of the criminal psychological trace analysis in each angle and the problems that should be paid attention to in the application of the criminal psychological trace analysis in the scene investigation from various angles of crime and the state of crime. And briefly summarizes the criminal psychological trace analysis technology in the current theory and practice in our country's current situation and development, and put forward the author's views and suggestions on related issues; Chapter 4th summarizes the difficulties and difficulties that may be encountered in the analysis of criminal psychological trace in scene investigation, and puts forward solutions, leading to the current task: to continuously improve the relevant theoretical research of criminal psychological trace, so as to guide the practice. And scientific use of various methods of criminal psychological trace analysis, summing up the experience and lessons, pay attention to the positive role of criminal psychological trace analysis in the scene exploration. The key chapter of this paper is the third chapter, which is the key point of the article analysis and the argument of the thesis, which is composed of ten sections, and proves the author's argument from different angles. In order to strengthen the persuasiveness and use value of the argument, the thesis begins with the basic concept of criminal psychological trace and carries on the analysis of the criminal psychological trace scientifically and reasonably. Further introduce the analysis of criminal psychological trace to every angle of scene investigation, and study from the angle of actual combat how to use criminal psychological trace analysis in scene investigation and what kind of value it can produce. Finally, it summarizes the problems and difficulties that should be paid attention to in the field investigation and application of the criminal psychological trace analysis, and generalizes and looks forward to the situation in our country.
