【摘要】： 未成年人犯罪已經(jīng)成為當(dāng)今世界普遍存在的社會(huì)問題,與環(huán)境污染、毒品并稱為世界三大公害。如何有效預(yù)防未成年人犯罪,遏制未成年人犯罪的不斷上升趨勢(shì),成為世界各國關(guān)注的重點(diǎn)問題之一。我國未成年人數(shù)量將近4億,未成年人犯罪形勢(shì)不容樂觀。未成年人犯罪呈現(xiàn)出低齡化、團(tuán)伙化、惡性化等新特征。盡管我國許多專家和學(xué)者對(duì)未成年人犯罪司法預(yù)防進(jìn)行了廣泛而深入的研究,但與西方發(fā)達(dá)國家相比仍存在一定的局限。本文結(jié)合英美德日等發(fā)達(dá)國家在未成年人犯罪司法預(yù)防上的經(jīng)驗(yàn),從建立專門司法機(jī)構(gòu)和完善實(shí)體法、程序法的角度,探討了完善我國未成年人犯罪司法預(yù)防的對(duì)策,希望能夠豐富未成年人犯罪預(yù)防研究理論,對(duì)有效預(yù)防未成年人犯罪起到現(xiàn)實(shí)的指導(dǎo)作用。
[Abstract]:Juvenile delinquency has become a universal social problem in the world, and environmental pollution. Drugs are regarded as the three major public hazards in the world. How to effectively prevent juvenile delinquency and curb the rising trend of juvenile delinquency, The number of minors in China is nearly 400 million, and the situation of juvenile delinquency is not optimistic. Juvenile delinquency presents a younger age and gangs. Although many experts and scholars in China have conducted extensive and in-depth research on the judicial prevention of juvenile delinquency, However, compared with the western developed countries, there are still some limitations. This paper, based on the experience of the developed countries, such as Britain, Germany and Japan, in the judicial prevention of juvenile delinquency, from the point of view of establishing specialized judicial institutions and perfecting substantive law and procedural law, This paper probes into the countermeasures to improve the judicial prevention of juvenile delinquency in China, hoping to enrich the research theory of juvenile delinquency prevention and play a practical guiding role in the effective prevention of juvenile delinquency.
