【摘要】：征求意見中的《社區(qū)矯正法》逆轉(zhuǎn)了社區(qū)矯正體制演進(jìn)的方向。《社區(qū)矯正法》(草案)拒絕從矯正概念中推導(dǎo)矯正部門所主張的"制服效應(yīng)"應(yīng)予肯定,將懲戒決定和執(zhí)行權(quán)交還公安機(jī)關(guān)的結(jié)論卻違背了行刑一體化思維和權(quán)力運(yùn)行規(guī)律。本著打破監(jiān)禁刑執(zhí)行困局即擴(kuò)大假釋的初心,矯正體制仍應(yīng)繼續(xù)在以下層面轉(zhuǎn)型。國家司法行政部門全面承擔(dān)社區(qū)矯正職能并非秀出權(quán)力肌肉,消除管理權(quán)與懲戒權(quán)間隙旨在明確行為與責(zé)任的邏輯關(guān)聯(lián),令懲戒設(shè)而少用;決定短期震懾性監(jiān)禁處分的權(quán)力移交區(qū)縣級社區(qū)矯正部門,既有效支持基層矯正活動又能節(jié)制懲戒沖動,但替代現(xiàn)行治安拘留做法無須在區(qū)縣級矯正部門專設(shè)拘禁場所和配置司法警察,指定輕警戒型監(jiān)獄承擔(dān)三至十天震懾性監(jiān)禁任務(wù),只涉及警察權(quán)內(nèi)部分配而非擴(kuò)張,而且自由刑執(zhí)行機(jī)制運(yùn)行更順暢;基層矯正人員是不可或缺的執(zhí)法力量,由其承擔(dān)督導(dǎo)和幫扶綜合職能,繼續(xù)優(yōu)化和規(guī)制手機(jī)定位技術(shù),社區(qū)矯正才可能名至實歸。
[Abstract]:The Community Correction Act in the solicitation of opinions reversed the direction of the evolution of the Community Correction system. The draft of the Community Correction Act (draft), which refuses to derive from the concept of correction the "uniform effect" advocated by the correction department, should be affirmed. The conclusion that the punishment decision and execution power is returned to the public security organ is contrary to the thinking of execution integration and the law of power operation. The system of correction should continue to be transformed at the following level. The national judicial administration department should take on the function of community correction in an all-round way not to show the power muscle, but to eliminate the gap between the management power and the disciplinary power in order to clarify the logical connection between behavior and responsibility, and make the discipline set up and used less; The transfer of power to the county level community correction departments, which decides on short-term deterrent custodial sanctions, not only effectively supports grass-roots correction activities, but also abstinents disciplinary impulses. However, replacing the current practice of public security detention does not require the establishment of special places of detention and the deployment of judicial police in district and county correctional departments, and designates light alert prisons to undertake the task of three to ten days of deterrent imprisonment, which only involves the internal distribution of police power rather than the expansion of police power. And the execution mechanism of free punishment runs more smoothly; the basic correction personnel is an indispensable law enforcement force, by which they assume the comprehensive functions of supervision and support, and continue to optimize and regulate mobile phone positioning technology, community correction can become a reality.
