【摘要】：作為文學(xué)藝術(shù)作品的法律題材電影,不可能繞過法律的內(nèi)容和主題,表現(xiàn)涉及法律的現(xiàn)實(shí)問題、激發(fā)社會(huì)大眾對(duì)法律的思考,這也正是法律題材電影應(yīng)擔(dān)負(fù)的文化使命。女性犯罪問題是我國(guó)法治進(jìn)程中必然要面對(duì)的問題,這一法律現(xiàn)象必然也會(huì)在法律題材電影中有所呈現(xiàn)和表達(dá)。通過對(duì)我國(guó)法律題材電影中的女性犯罪問題進(jìn)行研究,或可對(duì)我國(guó)當(dāng)下法治建設(shè)和民眾法律生活提供思考,更是可以為大眾文化文本對(duì)法治的闡釋和重構(gòu)提供可能。法律題材電影對(duì)女性犯罪的文學(xué)表達(dá)是一種既符合現(xiàn)實(shí)而又高于現(xiàn)實(shí)的文學(xué)表現(xiàn),它展現(xiàn)了女性現(xiàn)實(shí)生存的困境以及生存的本質(zhì)特征,具有極強(qiáng)的現(xiàn)實(shí)意義。此外,法律題材電影對(duì)女性犯罪的文學(xué)書寫又彰顯了文學(xué)對(duì)于法律的人文關(guān)懷,用文學(xué)的形式對(duì)法律問題進(jìn)行深層次探討,將法律思考融于文學(xué)藝術(shù)作品之中,將法意價(jià)值蘊(yùn)含于文學(xué)表達(dá)之內(nèi),既彰顯了文學(xué)對(duì)社會(huì)治理的積極意義,也突顯了法律題材電影對(duì)法治建設(shè)的助推作用。作為一種文學(xué)藝術(shù)作品,法律題材電影具有不可忽視的法治功能,它能表達(dá)現(xiàn)實(shí)困境和社會(huì)訴求,促進(jìn)法治觀念的傳播、推動(dòng)法治建設(shè),在匯聚觀眾對(duì)電影中所展現(xiàn)事件的評(píng)價(jià)、理解和闡釋的基礎(chǔ)上,對(duì)法律進(jìn)行再闡釋,進(jìn)而可能對(duì)人們的觀念和行為產(chǎn)生一定的影響,與法律實(shí)踐形成互動(dòng),為我國(guó)法治實(shí)踐中如何對(duì)待女性犯罪問題提供啟示。本論文主要從四個(gè)部分展開,試圖完成以下研究工作:一、結(jié)合我國(guó)的法律背景與女性犯罪的現(xiàn)實(shí)狀況,分析我國(guó)法律題材電影中涉及的女性犯罪現(xiàn)象并進(jìn)行分類和概括,完成對(duì)我國(guó)法律題材電影中女性犯罪的人物形象和犯罪分析,并深入探討電影中女性犯罪的類型、成因和特點(diǎn)。二、在對(duì)法律題材電影中女性犯罪問題的總結(jié)、分析的基礎(chǔ)上,從文學(xué)藝術(shù)現(xiàn)實(shí)表達(dá)的角度,對(duì)我國(guó)法律題材電影中女性犯罪現(xiàn)象進(jìn)行探討,深挖法律題材電影如何以文學(xué)的形式和方法表現(xiàn)女性犯罪的特征,并在此基礎(chǔ)上研究和探討這一文學(xué)表現(xiàn)背后的法意價(jià)值。三、通過對(duì)電影這一文學(xué)藝術(shù)形式所反映出的女性犯罪現(xiàn)象的本質(zhì)與特征進(jìn)行探討和研究,討論涉及女性犯罪問題的法律題材電影從文學(xué)的認(rèn)識(shí)功能與法治的大眾傳播與教化功能有機(jī)結(jié)合的價(jià)值。四、將文學(xué)與法治互動(dòng),探討法律題材電影對(duì)女性犯罪的文學(xué)書寫對(duì)我國(guó)法治實(shí)踐中如何對(duì)待女性犯罪問題的啟示。
[Abstract]:As a kind of literary and artistic works, it is impossible to bypass the content and theme of the law, to express the realistic problems related to the law, and to stimulate the public to think about the law. This is also the cultural mission that the legal subject matter movie should shoulder. The female crime is the question that our country must face in the process of ruling by law. This legal phenomenon must also be presented and expressed in the film of law subject matter. Through the research on the female crime in the film of law subject matter in our country, it may provide some thoughts on the construction of the rule of law and the legal life of the people in our country at present. It can also provide the possibility for the interpretation and reconstruction of the rule of law in the popular cultural texts. The literary expression of the female crime in the film of legal subject is a literary expression which is not only in line with the reality but also higher than the reality. It shows the dilemma of women's real existence and the essential characteristics of their existence, and it is of great practical significance. In addition, the literature writing of the crimes committed by women in the movies of law theme also shows the humanistic concern of literature for the law. In the form of literature, the legal problems are deeply discussed, the legal thinking is integrated into the works of literature and art, and the value of the meaning of law is implied in the literary expression, which shows the positive significance of literature to the social governance. As a kind of literary and artistic works, the film of law theme has the function of rule of law which can not be ignored, it can express the realistic predicament and social demand, and promote the dissemination of the concept of rule of law. To promote the construction of the rule of law, on the basis of gathering the audience to evaluate, understand and interpret the events shown in the film, to reinterpret the law, which may have a certain impact on people's ideas and behaviors, and interact with the practice of law. This paper mainly starts from four parts and tries to complete the following research work: first, combining the legal background of our country and the reality of female crime, This paper analyzes the phenomenon of female crime in Chinese legal movies, classifies and generalizes it, analyzes the characters and crimes of female crimes in Chinese legal movies, and probes into the types of female crimes in movies. Second, on the basis of summarizing and analyzing the problem of female crime in the film of legal subject, and from the angle of the realistic expression of literature and art, this paper probes into the phenomenon of female crime in the film of legal subject matter in our country. How to express the characteristics of female crime in the form and method of literature, and on the basis of which, to study and discuss the value of law and meaning behind this literary expression. This paper discusses and studies the essence and characteristics of the phenomenon of female crime, which is reflected in the literary and artistic form of film. This paper discusses the value of the combination of the cognitive function of literature and the function of mass communication and education of the rule of law in the film of legal subject related to the problem of female crime. Fourth, it interacts literature with the rule of law. This paper discusses how to deal with the female crime in the practice of rule of law by the literature writing of the film on the subject of law.
