【摘要】： 職務(wù)犯罪是危害社會(huì)發(fā)展的一顆毒瘤,是國(guó)際社會(huì)中普遍存在的一種不良之風(fēng),它不僅是一個(gè)法律問題,更是一個(gè)社會(huì)問題,我國(guó)正處于社會(huì)轉(zhuǎn)型時(shí)期,這一現(xiàn)象尤為突出,控制職務(wù)犯罪成為黨和國(guó)家當(dāng)前的一項(xiàng)重要任務(wù)。毫無疑問,對(duì)職務(wù)犯罪控制的研究是一項(xiàng)系統(tǒng)工程,需要從多視角多維度進(jìn)行長(zhǎng)期艱難的探索。從對(duì)中國(guó)期刊網(wǎng)上有關(guān)職務(wù)犯罪控制的論文進(jìn)行抽樣分析可以發(fā)現(xiàn),不少文章屬于“經(jīng)驗(yàn)總結(jié)型”或“就事論事型”,學(xué)術(shù)含量較高的理性分析文章偏少,說明職務(wù)犯罪控制研究的層次有待提升,為此,本研究擬選擇“元理論”研究視角,側(cè)重對(duì)職務(wù)犯罪控制的機(jī)理分析,透過紛繁復(fù)雜的職務(wù)犯罪現(xiàn)象,抽取控制職務(wù)犯罪的一般本質(zhì)與規(guī)律,探討職務(wù)犯罪控制的內(nèi)在機(jī)理,從而構(gòu)建確保職務(wù)犯罪控制有效性的理論體系。本研究的主要內(nèi)容包括三個(gè)部分:第一部分為職務(wù)犯罪及其控制本體論研究;第二部分為職務(wù)犯罪控制機(jī)制分析;第三部分為職務(wù)犯罪控制有效模型設(shè)計(jì)。 為了提高職務(wù)犯罪控制的有效性,本研究引入權(quán)變理論作為分析工具,對(duì)職務(wù)犯罪控制有效性的制約因素進(jìn)行結(jié)構(gòu)分析與模型綜合。用一種或多種關(guān)系模式或分系統(tǒng)的配置結(jié)構(gòu)分析職務(wù)犯罪控制過程,預(yù)示在特定情境中不同職務(wù)犯罪控制方式方法的有效性,為人們選擇相對(duì)有效的職務(wù)犯罪控制方式方法提供參考依據(jù)。此外,本研究還采用比較研究方法,系統(tǒng)分析方法,定性定量綜合研究方法,實(shí)證研究方法等。 本研究具有明顯的原創(chuàng)意義與前沿性質(zhì),首先,選擇的研究視角比較獨(dú)特,避免了人云亦云的低層次重復(fù)研究現(xiàn)象;其次,本研究選擇的分析工具比較科學(xué),權(quán)變理論已經(jīng)證實(shí)是比較有效的分析工具;第三,本研究的內(nèi)容不僅全面而且新穎,不少是一般職務(wù)犯罪研究所沒有涉及到的,這樣就能保持職務(wù)犯罪控制研究與時(shí)俱進(jìn);第四,本研究能夠豐富檢察理論,為檢察機(jī)關(guān)提供理論支持。 本研究具有十分明顯的應(yīng)用價(jià)值,職務(wù)犯罪現(xiàn)象紛繁復(fù)雜,職務(wù)犯罪控制的措施也多種多樣,如果就事論事研究,就不能高屋建瓴,揭示本質(zhì),掌握規(guī)律。本研究將有利于提高檢察人員的理論水平,利于提高檢察工作效率,為職務(wù)犯罪控制決策提供理論參考,本研究具有明顯的開放性特點(diǎn),研究成果可以直接運(yùn)用于職務(wù)犯罪控制實(shí)踐,也可以用于一般的犯罪預(yù)防與控制。
[Abstract]:Job-related crime is a cancer that endangers the development of the society and is a kind of bad wind that exists in the international society. It is not only a legal problem but also a social problem. Our country is in the period of social transformation. This phenomenon is particularly prominent, the control of job-related crimes has become an important task of the party and the state. There is no doubt that the research on the control of job-related crimes is a systematic project. It is necessary to make a long and difficult exploration from many perspectives and many dimensions. From the sampling analysis of the papers on the control of job-related crimes on the web of Chinese periodicals, we can find out. Many articles belong to the "experience summary" or "matter on the matter", the academic content of the rational analysis of the relatively small, indicating that the level of duty crime control needs to be improved, for this reason. This study intends to choose the "meta-theory" research perspective, focusing on the mechanism of duty crime control analysis, through the complex phenomenon of duty crime, extract the general nature and law of the control of duty crime. The main contents of this study include three parts: the first part is the study of duty crime and its control ontology; The second part is the analysis of duty crime control mechanism. The third part is the effective model design of duty crime control. In order to improve the effectiveness of job crime control, this study introduces contingency theory as an analytical tool. The structural analysis and model synthesis of the restricting factors of the effectiveness of duty crime control are carried out, and the process of duty crime control is analyzed with one or more relational models or the configuration structure of sub-system. Foreshadowing the effectiveness of different methods of job crime control in a specific situation, providing a reference for people to choose relatively effective methods of job crime control. In addition, this study also uses comparative research methods. Systematic analysis method, qualitative and quantitative comprehensive research method, empirical research method and so on. This research has the obvious original meaning and the frontier nature. Firstly, the research angle chosen is quite unique, which avoids the phenomenon of low-level repeated research. Secondly, the analytical tools selected in this study are more scientific, contingency theory has been proved to be a more effective analysis tool; Third, the contents of this study are not only comprehensive and novel, many of them are not involved in the general job-related crime research institute, so as to keep the research of duty crime control keep pace with the times; In 4th, this research can enrich the procuratorial theory and provide theoretical support for the procuratorial organ. This research has very obvious application value, the phenomenon of duty crime is complicated, the measure of duty crime control is also varied, if we discuss the subject matter, we can not reveal the essence from the height. This study will help to improve the theoretical level of procuratorial personnel, improve the efficiency of procuratorial work, and provide a theoretical reference for decision-making on crime control. The research results can be directly used in the practice of duty crime control, but also can be used in general crime prevention and control.
