【摘要】：從國際社會刑罰的發(fā)展趨勢可以看出,輕刑化、非監(jiān)禁化逐漸成為國家刑罰文明的發(fā)展趨勢,社區(qū)矯正在此背景下應(yīng)運而生。我國的社區(qū)矯正工作從開始試點到全面實行至今現(xiàn)已試行了十三年,貴州作為全國社區(qū)矯正工作第二批擴大試點省份之一,也已試行近七年。然而作為一種新型的刑罰執(zhí)行方式,社區(qū)矯正工作雖在逐漸完善其工作機制,但目前卻仍沒有一部完善的法律法規(guī)來規(guī)范,在操作層面亦存在許多不盡如人意的地方。貴州省H區(qū)位于貴州省北部,是黔北綜合經(jīng)濟區(qū)的核心區(qū),筆者選取該區(qū)社區(qū)矯正工作的實際情況作為調(diào)研對象,通過直接參與貴州省H區(qū)社區(qū)矯正工作每個階段的具體實施過程、收集整理相關(guān)數(shù)據(jù)資料、到H區(qū)各司法所實地走訪、與該區(qū)社區(qū)矯正工作人員深入訪談,從實證研究的角度對該區(qū)矯正工作進行評述,特別是針對當(dāng)前發(fā)現(xiàn)的制約該區(qū)社區(qū)矯正工作發(fā)展的突出問題,利用自己有限的法律知識分析這些問題的形成原因,并結(jié)合2016年8月由最高人民法院、最高人民檢察院、公安部、司法部聯(lián)合制定下發(fā)的《關(guān)于進一步加強社區(qū)矯正工作銜接配合管理的意見》,及借鑒部分地區(qū)依照該意見出臺的一些最新工作措施,提出完善H區(qū)社區(qū)矯正工作的可行性措施,以期更好地推進和實現(xiàn)社區(qū)矯正工作的權(quán)威、規(guī)范、有效執(zhí)行。本文總共分為四個部分,大約25000字左右,內(nèi)容主要如下:緒論由三個部分組成:第一部分簡單陳述本文的選題背景;第二部分介紹本文寫作的理論意義和實務(wù)意義;第三部分主要敘述社區(qū)矯正的含義、特征及價值。第一章對本次調(diào)研的基本情況進行介紹,主要包括選擇貴州省H區(qū)作為調(diào)研地點的理由、調(diào)研經(jīng)過、調(diào)研方法、調(diào)研目的。第二章對貴州省H區(qū)社區(qū)矯正進行調(diào)查和分析。該章第一部分展示調(diào)研收集的貴州省H區(qū)社區(qū)矯正工作數(shù)據(jù)、資料,并進行統(tǒng)計分析;第二部分在分析數(shù)據(jù)的基礎(chǔ)上,結(jié)合筆者對貴州省H區(qū)社區(qū)矯正工作人員的走訪、洽談,對該區(qū)社區(qū)矯正工作進行事實分析,從而發(fā)現(xiàn)該區(qū)社區(qū)矯正工作在四個階段存在的主要問題和困難:適用社區(qū)矯正前的調(diào)查評估階段存在評估難以落實、效力難以認定、調(diào)查內(nèi)容和標準不明確;接受社區(qū)服刑人員階段存在人員和文書的接收程序不規(guī)范、主體責(zé)任不明確;實施社區(qū)矯正階段存在管理、懲罰措施不完善、人財物資缺乏;解除社區(qū)矯正階段存在收監(jiān)主體有爭議、收監(jiān)難等。同時,通過對這些問題的解析找到產(chǎn)生的原因。第三章針對目前貴州省H區(qū)社區(qū)矯正工作開展過程中存在的突出問題提出完善建議。該章分別從社區(qū)矯正工作的四個階段進行闡述:適用社區(qū)矯正前的調(diào)查評估階段,規(guī)范調(diào)查程序,明確調(diào)查效力;接受社區(qū)服刑人員階段,規(guī)范銜接程序,明確部門職責(zé);實施社區(qū)矯正階段,細化管理規(guī)定,補足資源短板;解除社區(qū)矯正階段明確收監(jiān)主體,克服收監(jiān)難題。
[Abstract]:From the development trend of punishment in the international community, it can be seen that light punishment, non-imprisonment gradually become the development trend of national penalty civilization. Community correction in this context emerged as the times require. From the start of the pilot to the full implementation of the community correction work has been implemented for 13 years, Guizhou Province as the second batch of expansion of the national community correction pilot provinces. It has been tried for nearly seven years. However, as a new type of penalty execution, community correction is gradually improving its working mechanism, but there is still no perfect laws and regulations to regulate. In the operational level there are many unsatisfactory places. Guizhou Province H is located in the northern part of Guizhou Province is the core area of Qianbei Comprehensive Economic Zone the author selects the actual situation of the community correction work in this area as the research object. Through the direct participation in the specific implementation process of each stage of community correction in H District of Guizhou Province, collect and sort out relevant data, visit to various judicial offices in H District, and conduct in-depth interviews with community correction staff in this area. From the perspective of empirical research, this paper comments on the work of correction in this area, especially in the light of the outstanding problems found at present which restrict the development of community correction in this area. Using their limited legal knowledge to analyze the causes of these problems, and combined with August 2016 by the Supreme people's Court, the Supreme people's Procuratorate, the Ministry of Public Security. The Ministry of Justice jointly formulated and issued "opinions on further strengthening the Link and Coordination Management of Community Corrections" and drew lessons from some latest work measures issued by some regions in accordance with this opinion. In order to promote and realize the authority, standardization and effective implementation of community correction work, this paper is divided into four parts, about 25000 words. The main contents are as follows: the introduction consists of three parts: the first part simply describes the background of this paper; The second part introduces the theoretical and practical significance of this writing. The third part mainly describes the meaning, characteristics and value of community correction. The first chapter introduces the basic situation of this research, mainly including the reasons for choosing H District of Guizhou Province as the research site, and the investigation process. The second chapter is to investigate and analyze the community correction in H District of Guizhou Province. The first part of this chapter shows the collected data and data of community correction in H District of Guizhou Province, and carries on the statistical analysis; The second part on the basis of the analysis of data, combined with the author of the H District of Guizhou Province community correction staff visits, negotiations, community correction work in this area for factual analysis. The main problems and difficulties in the four stages of community correction work in this area are as follows: it is difficult to carry out the investigation and evaluation stage before the application of community correction, the effectiveness is difficult to determine, and the contents and standards of the investigation are not clear; In the stage of accepting community prisoners, the receiving procedure of personnel and documents is not standardized, and the responsibility of the subject is not clear; The implementation of community correction stage of management, punishment measures are not perfect, people and property capital lack; In the stage of community correction, there are disputes about the subject of receiving prison, and it is difficult to accept the prison. At the same time. By analyzing these problems, we find out the causes. Chapter three puts forward some suggestions to improve the problems existing in the process of community correction in H district of Guizhou province. This chapter is based on the four levels of community correction work. Paragraph elaborated:. It is applicable to the investigation and evaluation stage before community correction. Standardizing the investigation procedure and clarifying the investigation effect; Accepting community prisoners, standardizing the procedure of linking up, and clarifying the responsibilities of the departments; Implement the community correction stage, refine the management regulations, and make up the short board of resources; Release the community correction stage to clear the subject of prison, to overcome the difficult problem.
