【摘要】：信息化偵查在發(fā)展過(guò)程中其理論地位的變遷使相應(yīng)法律規(guī)制的要求也不斷提高。而我國(guó)長(zhǎng)期以來(lái)"重結(jié)果、輕過(guò)程"和"重打擊、輕保護(hù)"的傳統(tǒng)理念使相關(guān)法律規(guī)制在設(shè)計(jì)層面就存在著立法技術(shù)欠佳,程序保障不足的問(wèn)題。既有法律規(guī)范的錯(cuò)位缺失使偵查活動(dòng)在社會(huì)、法律、實(shí)踐等維度上引發(fā)了不同程度的沖突,為此應(yīng)在法律規(guī)范上構(gòu)建以基本權(quán)利為核心、配套立法為補(bǔ)充的法律框架。在實(shí)施過(guò)程中應(yīng)依據(jù)信息屬性與行為性質(zhì),根據(jù)任意偵查理論對(duì)不同種類的偵查行為設(shè)定相應(yīng)行為實(shí)施路徑及合法邊界,以解決其維度沖突,達(dá)到懲罰犯罪與保障人權(quán)的統(tǒng)一,充分發(fā)揮信息化偵查的主導(dǎo)作用。
[Abstract]:The change of its theoretical position in the course of the development of information investigation makes the requirements of the corresponding legal regulation raise constantly. However, for a long time, our country has been "emphasizing the result, not the process" and "the heavy attack". The traditional concept of "light protection" makes the relevant legal regulations have the problems of poor legislative technology and inadequate procedural protection at the design level. The lack of dislocation of the existing legal norms makes the investigation activities in the society and the law. Practice and other dimensions have led to different degrees of conflict, so we should build a legal framework based on basic rights as the core and complementary legislation. In the process of implementation, it should be based on the nature of information and behavior. According to the theory of arbitrary investigation, different kinds of investigation behavior should be set up the implementation path and legal boundary, in order to solve the dimensional conflict, and achieve the unity of punishing crime and protecting human rights. Give full play to the leading role of information investigation.
