【摘要】：社區(qū)服務(wù)令既熟悉又陌生的一項制度，它是一種要求犯罪人在特定的時間、特定的地點完成一定的社區(qū)服務(wù)，已到達教育、矯正之目的的非監(jiān)禁性刑罰活動。之所以說熟悉，是因為我們的學(xué)者已經(jīng)對其研究多年，我們的司法部門更是付諸了實踐行動。而之所以說陌生，是因為至今我國仍然沒有建立起自己的社區(qū)服務(wù)令制度，不僅如此，原有的司法實踐探索也被迫中止。 但行刑社會化、輕緩化已然成為一種新的趨勢，刑罰效益理念也越來越受到重視，傳統(tǒng)的監(jiān)禁刑罰方式的弊端日益顯現(xiàn)，在這樣的形勢下，社區(qū)服務(wù)令制度必然將在未來的刑事司法領(lǐng)域占有重要的一席之地，在我國亦是如此，但是，構(gòu)建我國的社區(qū)服務(wù)令制度還面臨許多的問題。論文從我國當前的實際情況出發(fā)，為我國的社區(qū)服務(wù)令制度的建構(gòu)探索一條合理、合法的路徑。全文共約3.9萬字，，共分為五個部分：： 第一部分：社區(qū)服務(wù)令制度概述，這部分主要介紹了社區(qū)服務(wù)令制度的歷史起源與發(fā)展，在分析與對比的基礎(chǔ)了界定了符合我國國情的社區(qū)服務(wù)令制度概念，隨后闡述了社區(qū)服務(wù)令的性質(zhì)和特定。 第二部分：社區(qū)服務(wù)令制度的理論基礎(chǔ)，制度的建立需要深厚的理論依據(jù)作為后盾，這部分分析了該制度的充實的理論基礎(chǔ)，包括深化的復(fù)歸理論、刑事賠償理論、行刑社會化、輕緩化理念等等。 第三部分：社區(qū)服務(wù)令制度的價值評析，該制度得以存在和發(fā)展的重要原因就在于它具有巨大的價值，對犯罪人、其家庭乃至社會都會產(chǎn)生積極影響。 第四部分：社區(qū)服務(wù)令制度的域外考察與借鑒，法治的發(fā)展離不開對國外先進制度的引進與借鑒，這部分對幾個典型國家的社區(qū)服務(wù)令制度進行了考察，并評析了其對我國的借鑒意義。 第五部分：社區(qū)服務(wù)令制度在我國的構(gòu)建，這是文章最主要的部分，闡明了我國社區(qū)服務(wù)令制度應(yīng)當適用的對象、決定主體、執(zhí)行主體、工作內(nèi)容及其期限等各個方面構(gòu)想，提供一個具體的建構(gòu)方案。
[Abstract]:The community service order is not only familiar with but unfamiliar to a system , it is a kind of non - custodial sentence activity that requires the offender to complete certain community service at a certain time and a certain place , has reached the aim of education and correction . However , in the current situation of our country , the system of community service order will find a reasonable and legal path for the construction of our community service order system . The first part : The system of community service order system is summarized , this part mainly introduces the historical origin and development of community service order system . On the basis of analysis and comparison , the concept of community service order system which accords with the national conditions of our country is defined , and the nature and specific characteristics of community service order are expounded . The second part : the theory foundation of community service order system , the establishment of the system needs profound theoretical basis as the backing , this part analyses the theoretical foundation of the system , including the deepening of the theory of restoration , the theory of criminal compensation , the socialization of the execution of execution , the concept of the light and the slow down , etc . The third part : The value of community service order system is analyzed . The important reason for the existence and development of the system lies in its great value , which can exert positive influence on the perpetrators , their families and even society . The fourth part : the outside investigation and reference of community service order system , the development of the rule of law is inseparable from the introduction and reference of foreign advanced system , this part investigates the community service order system of several typical countries , and evaluates its reference significance to our country . The fifth part : The construction of community service order system in our country is the most important part of the article , which illustrates the object , the main body , the execution subject , the working content and the time limit of the community service order system in our country , and provides a concrete construction scheme .
