在社會(huì)生活中,合同能夠促成交易高效且低成本的進(jìn)行。而格式合同是合同廣泛運(yùn)用的變體之一,常由法律專業(yè)人士精心撰寫以規(guī)避可能存在的法律風(fēng)險(xiǎn)。格式合同中不可理解的或不清晰的術(shù)語(yǔ)和表達(dá)等這類語(yǔ)言因素極可能使非法律專業(yè)人士難以理解合同內(nèi)容,從而不能履行合同或保護(hù)自己的權(quán)益。本文借助語(yǔ)料庫(kù)語(yǔ)言學(xué)方法,研究分析格式合同的不可理解性以及可能導(dǎo)致這類不可理解性的因素。本文首先基于文獻(xiàn)回顧的方法總結(jié)整理出22種可能造成文本不可理解性的因素,然后基于這些因素將不可解性分為七大類,并構(gòu)建了研究框架。在對(duì)所收集的15篇(四類)格式合同進(jìn)行研究分析后發(fā)現(xiàn),其中“修飾語(yǔ)-名詞短語(yǔ)與合成詞”及“術(shù)語(yǔ)困難”是出現(xiàn)頻次最高的兩個(gè)因素。專業(yè)知識(shí)相關(guān)的不可理解性和詞匯層面的不可理解性是出現(xiàn)頻次最高的兩類。此外,本文運(yùn)用變異系數(shù)法,計(jì)算出各類合同及各篇合同的不可理解性指數(shù)以評(píng)估其不可理解性程度。通過(guò)對(duì)比不可理解性指數(shù),保險(xiǎn)類格式合同是最難理解的種類,而用戶協(xié)議類格式合同是最簡(jiǎn)單的種類�；谝陨涎芯堪l(fā)現(xiàn),本研究建議合同起草者與非法律專業(yè)人士都應(yīng)為合同的可理解性而共同努力,倡導(dǎo)監(jiān)管者、立法者和語(yǔ)言學(xué)家共同合作,設(shè)立一套行之有效的標(biāo)...
