勿庸置疑,法律自始以來一直都在人類社會(huì)起著十分重要的作用,并將繼續(xù)起著關(guān)鍵作用。法律在世界各個(gè)角落影響著人類生活的方方面面,其重要性體現(xiàn)在規(guī)范人類的一舉一動(dòng)。正是因?yàn)榉傻拇嬖?人們知道其享受哪些權(quán)利,遵守哪些義務(wù);其權(quán)利受到侵犯時(shí)可以享受何等救濟(jì)權(quán),而在未能遵守法律時(shí)又必須面對的法律后果。然而,事實(shí)上,法律與普通民眾之間似乎總是存在一條無法跨越的鴻溝,其原因在于起草法律條文時(shí)使用的語言遠(yuǎn)遠(yuǎn)超過普通民眾的理解能力。雖然立法者的真正本意在于保護(hù)民眾在其權(quán)益受到侵害時(shí)享有訴諸法律的合法權(quán)利,但是語言難以理解的法律實(shí)際上是將普通民眾拒之千里之外了。因此,法律必須盡可能地簡明易懂,這樣沒有接受過任何法律知識教育的普通民眾可以舉起法律這把武器,更好地維護(hù)自身的權(quán)利和利益。本論文旨在揭示立法過程中使用簡明法律語言的重要性,并提出如何通過使用簡明法律語言提高法律條文可讀性的初步建議。本論文通過對立法過程中使用法律語言方式的傳統(tǒng)觀點(diǎn)進(jìn)行回顧,介紹當(dāng)今全球使用簡明法律語言的趨勢,對傳統(tǒng)觀點(diǎn)的批判和對當(dāng)前簡明語言趨勢的支持,最終提出了本作者建議起草法律條文的最佳方式,幫助律師、立法者以及政府了解到法律信息...
