【摘要】：中國傳統(tǒng)法律文化源遠(yuǎn)流長,在其兩千余年的發(fā)展歷程中曾經(jīng)締造了輝煌的中華法系。隨著時(shí)代的發(fā)展,中國傳統(tǒng)法律文化賴以存在的經(jīng)濟(jì)、政治基礎(chǔ)都已經(jīng)消失,其從整體上已經(jīng)不能支撐我國的法制現(xiàn)代化建設(shè)。要使得中國傳統(tǒng)法律文化獲得新生,就需要對(duì)其進(jìn)行現(xiàn)代化改造,對(duì)其進(jìn)行批判的吸收。本文擬從這種需求出發(fā),在對(duì)中國傳統(tǒng)法律文化和法制現(xiàn)代化分析的基礎(chǔ)上,提出如何改造中國傳統(tǒng)法律文化的基本路徑,從而期望能為建設(shè)中國現(xiàn)代法律文化提供一個(gè)有益的探索。 本文一共分為三章,在第一章中,首先對(duì)文化與法律文化的概念進(jìn)行了討論,在分析中外學(xué)者所提出的文化概念的基礎(chǔ)上得出結(jié)論：由于文化概念的廣義性和復(fù)雜性,單純的描述是無法涵蓋文化的全部內(nèi)涵的。筆者試圖通過哲學(xué)抽象的方法將對(duì)文化的概念的理解總結(jié)為廣義、中義、狹義三種不同文化觀,以期望對(duì)文化的內(nèi)涵能有一個(gè)較為全面的認(rèn)識(shí)。在確定了文化概念的基礎(chǔ)上展開了對(duì)法律文化的分析,認(rèn)為：法律文化乃是人類在長期的法律實(shí)踐中所創(chuàng)造有關(guān)法律意識(shí)、法律思想、法律制度和法律設(shè)施等一系列成果的總和。本章的第二小節(jié)對(duì)中國傳統(tǒng)法律文化進(jìn)行了闡述,首先探討了中國傳統(tǒng)法律文化的起止時(shí)間,然后對(duì)中國傳統(tǒng)法律文化的價(jià)值取向和特征進(jìn)行了詳細(xì)的說明。通過本節(jié)的探討,旨在對(duì)中國傳統(tǒng)法律文化有一個(gè)基本的、明確的認(rèn)識(shí)。 本文第二章圍繞中國傳統(tǒng)法律文化與現(xiàn)代化的問題展開討論。在分析現(xiàn)代化與法制現(xiàn)代化內(nèi)涵的基礎(chǔ)上指出了中國傳統(tǒng)法律文化對(duì)法制現(xiàn)代化有著積極的和消極的兩方面的作用。在積極作用的闡述中提出了對(duì)于中國傳統(tǒng)法律文化改造的可能性,認(rèn)為中國傳統(tǒng)法律文化是以封建的自然經(jīng)濟(jì)為基礎(chǔ)的,總的來說,它已經(jīng)不能適應(yīng)于我國法制現(xiàn)代化建設(shè)的需要,但是在中國傳統(tǒng)法律文化中有著很多進(jìn)步的,現(xiàn)代的因素,對(duì)這些善加利用將會(huì)使得我國法制現(xiàn)代化建設(shè)取得事半功倍的效果。此外,由于我們無法完全與傳統(tǒng)隔斷,所以這也成為對(duì)中國傳統(tǒng)法律文化進(jìn)行現(xiàn)代化改造的另一個(gè)因素。在分析中國傳統(tǒng)法律文化對(duì)法制現(xiàn)代化建設(shè)的消極作用中提出：正是因?yàn)閭鹘y(tǒng)法律文化中的諸如宗法思想、特權(quán)思想、等級(jí)思想等這些不利于法制現(xiàn)代化建設(shè)因素的存在,再者,我國當(dāng)前的法律制度在相當(dāng)程度上源自于移植,這也在一定程度上也造成了較為先進(jìn)的制度同較為落后的文化之間的沖突。鑒于此,對(duì)中國傳統(tǒng)法律文化進(jìn)行現(xiàn)在化的改造就勢在必行。通過對(duì)傳統(tǒng)法律文化的現(xiàn)代化改造,使其成為能夠支撐我國法制現(xiàn)代化建設(shè)的先進(jìn)法律文化。 本文最后一章主要探討如何對(duì)中國傳統(tǒng)法律文化進(jìn)行現(xiàn)代化的改造問題,期望能對(duì)實(shí)現(xiàn)中國傳統(tǒng)法律文化的現(xiàn)代化改造提供一個(gè)可行的路徑。本章在前文的基礎(chǔ)上提出對(duì)中國傳統(tǒng)法律文化進(jìn)行現(xiàn)代化的改造要堅(jiān)持以中國傳統(tǒng)法律文化為主體,發(fā)揚(yáng)傳統(tǒng)法律文化中積極的因素,同時(shí)也要吸收借鑒西方先進(jìn)的、優(yōu)秀的法律文化成果,立足中國國情,從實(shí)際出發(fā)來建立我國現(xiàn)代法律文化。
[Abstract]:Chinese traditional legal culture has a long history, in the course of development of its more than two thousand years have created the splendid Chinese law. With the development of the times, there are China traditional legal culture on the basis of political economy, have disappeared, it overall cannot support the modernization of legal system in our country. The traditional legal culture China rebirth that we need to modernize its, a critique on the absorption. This paper starts from this demand, based on the analysis of China traditional legal culture and the legal system modernization, put forward how to reform the basic path China traditional legal culture, which is expected to provide a useful exploration for the construction of China modern legal culture.
This paper is divided into three chapters. In the first chapter, firstly the concept of culture and legal culture are discussed, the conclusion based on the analysis of Chinese and foreign scholars have put forward the concept of culture: because the broad and complex concept of culture, the description is unable to cover all the connotation of culture. The author tries to approach abstract the philosophy of the concept of culture understanding summed up as generalized, in three different cultural meaning, narrow view, in the hope of the connotation of culture can have a more comprehensive understanding. On the basis of the concept of culture on analysis of legal culture: legal culture is the legal consciousness that man has created in the long legal practice of legal thought, legal system and legal facilities such as the sum of a series of achievements in this chapter. The second section elaborates the Chinese traditional legal culture, first study The starting and ending time of Chinese traditional legal culture is expounded. Then, the value orientation and characteristics of Chinese traditional legal culture are explained in detail. Through the discussion of this section, the aim is to have a basic and clear understanding of Chinese traditional legal culture.
The second chapter focuses on China traditional legal culture and modern issues. Based on the analysis of the connotation of the modernization and the modernization of legal system Chinese pointed out that traditional legal culture has positive and negative effects of the two aspects of the modernization of the legal system. In the positive role of the paper put forward the possibility for the transformation of traditional legal culture Chinese, think Chinese traditional legal culture is the feudal natural economy as the foundation, in general, need it already can not adapt to the modernization construction of our country's legal system, but in Chinese traditional legal culture has a lot of progress, modern factors, these will make good use of the modernization of China's legal system to achieve a multiplier effect. In addition, because we cannot completely with the traditional partition, so it has become the modernization of the traditional legal culture Chinese for another . the analysis put forward China traditional legal culture negative effect on the construction of the modernization of the legal system: it is because of the traditional legal culture such as the patriarchal ideology, the privilege of thinking, thinking level of these factors is not conducive to the construction of the modernization of the legal system, moreover, China's current legal system to a certain extent from the transplant. To a certain extent, also caused the conflict between culture and advanced system is relatively backward. In view of this, the traditional legal culture of Chinese now is in need of reform. Through the modernization of the traditional legal culture, make it become capable of supporting advanced legal culture modernization construction of our country's legal system.
Transformation of the last chapter of this paper mainly discusses how to China by the modernization of the traditional legal culture, hoping to provide a viable path to realize the modernization of the traditional legal culture Chinese. This chapter on the basis of the above proposed transformation of modernization of traditional legal culture China to adhere to the traditional legal culture as the main China and carry forward the positive factors of traditional legal culture, but also to absorb the western advanced legal culture, outstanding achievements, based on the Chinese conditions, from the reality to establish a modern legal culture in China.
