【摘要】：與其他類型司法鑒定相比,司法精神鑒定較為特殊。精神醫(yī)學(xué)的特點決定了刑事責(zé)任能力認定與司法精神鑒定直接對接,且鑒定意見本身也存在一定的錯誤。鑒定人在刑事責(zé)任認定問題上的強勢、鑒定內(nèi)容無法通俗化表達、鑒定意見結(jié)果不確定等問題客觀存在。如果實體的改革無法達到目的,那么對訴訟程序進行調(diào)整,如加強程序的參與性,建立重點案件鑒定人出庭制度,選任精神醫(yī)學(xué)專家擔(dān)任人民陪審員等,才是化解鑒定意見風(fēng)險、提高司法公信力的有效途徑。
[Abstract]:Compared with other types of judicial expertise, forensic spirit expertise is more special. The characteristics of psychiatry determine the direct connection between the identification of criminal responsibility ability and the judicial spirit appraisal, and the appraisal opinion itself also has certain mistakes. There are many problems, such as the strength of the appraiser in the problem of criminal responsibility, the difficulty of expressing the identification content and the uncertainty of the result of the appraisal opinion and so on. If the reform of the entity fails to achieve its purpose, then the legal procedure should be adjusted, such as strengthening the participation of the procedure, establishing a system of court attendance of experts in key cases, and selecting psychiatrists as people's assessors, etc. It is an effective way to resolve the risk of appraisal opinion and improve judicial credibility.
