【摘要】：目的對我國《藥品管理法》修訂之藥品上市許可制度設(shè)計提出建議;方法對中美歐藥品上市許可制度設(shè)計差異進行比較,分析歐美制度優(yōu)勢;結(jié)果與結(jié)論提出上市許可制度的4個核心要素,建議允許申請人和申請持有人變更,取消上市許可與生產(chǎn)企業(yè)捆綁,強化申請人和申請持有人對藥品全生命周期的安全性有效性保證義務(wù)與責(zé)任,藥品生產(chǎn)企業(yè)與分銷企業(yè)的質(zhì)量保證和供應(yīng)鏈追溯責(zé)任與義務(wù)。
[Abstract]:Objective to put forward some suggestions on the design of drug listing license system revised by the Drug Administration Law of China, methods the differences in the design of drug listing license system between China and the United States and Europe were compared, and the advantages of Europe and the United States were analyzed. Results and conclusion the four core elements of the listing license system are put forward, and it is suggested that the applicant and the applicant holder should be allowed to change, cancel the binding between the listing license and the production enterprise, strengthen the obligation and responsibility of the applicant and the applicant holder to guarantee the safety and effectiveness of the whole life cycle of the drug, and the quality assurance and supply chain traceability responsibility and obligation of the drug production enterprise and the distribution enterprise.
