【摘要】：關(guān)于超藥品說明書用藥的問題,國內(nèi)研究關(guān)注較少,學(xué)術(shù)基礎(chǔ)較為薄弱,缺乏系統(tǒng)的理論依據(jù)和規(guī)制體系。本文試圖通過對超說明書用藥立法的探討,推動國內(nèi)對超藥品說明書用藥的立法研究和體系構(gòu)建,解決醫(yī)療機(jī)構(gòu)及其從業(yè)人員超藥品說明書用藥行為與患者的生命權(quán)、健康權(quán)的沖突,緩和當(dāng)前略顯緊張醫(yī)患關(guān)系。本論文對超藥品說明書用藥的立法問題進(jìn)行研究,通過學(xué)校圖書館、互聯(lián)網(wǎng)電子數(shù)據(jù)庫、中國法律檢索系統(tǒng)等途徑,搜集期刊、報紙、學(xué)術(shù)論文、臨床病歷和法律法規(guī)等資料對該問題理論分析,主要分為三個部分進(jìn)行研究。第一部分“超藥品說明書用藥立法探討的必要性”。該部分筆者采用文獻(xiàn)研究和案例分析的方法,從超藥品說明書用藥引發(fā)的法律問題出發(fā),詳細(xì)分析超藥品說明書用藥矛盾產(chǎn)生的原因,然后提出法律要解決的關(guān)鍵問題是平衡醫(yī)患關(guān)系。第二部分“國內(nèi)外規(guī)制超藥品說明書用藥的法律制度”。該部分筆者通過比較分析,闡明國內(nèi)超藥品說明書用藥法律規(guī)制的現(xiàn)狀,介紹一些國外的經(jīng)驗做法,為我國立法提供借鑒。第三部分“超藥品說明書用藥的法律規(guī)制構(gòu)建”。該部分筆者立足法學(xué)、醫(yī)學(xué)、藥學(xué)、倫理學(xué)相關(guān)理論基礎(chǔ),從多學(xué)科角度展開交叉研究,對法律效力層級選擇、確立法律原則、具體內(nèi)容構(gòu)建、明確責(zé)任歸責(zé)、法律糾紛的解決、立法構(gòu)想的不足六個方面詳細(xì)展開分析與探討。筆者認(rèn)為,應(yīng)先由國家衛(wèi)生與計劃生育委員會針對超說明書用藥問題制定部門規(guī)章,建立起一整套的保障機(jī)制。該機(jī)制應(yīng)涵蓋超藥品說明書用藥的風(fēng)險定級,分級知情同意流程,操作與監(jiān)督程序,標(biāo)準(zhǔn)制定機(jī)構(gòu)的設(shè)立,醫(yī)療機(jī)構(gòu)及其從業(yè)人員減輕或免除法律責(zé)任的條件,藥品說明書修改程序的改進(jìn),藥品銷售企業(yè)對其宣傳資料應(yīng)承擔(dān)的法律責(zé)任等方面的內(nèi)容。然后再逐步涉及修改完善,及時根據(jù)社情及醫(yī)療服務(wù)水平的變化不斷調(diào)整,待條件成熟時再提請國務(wù)院制定行政法規(guī)。通過立法對超藥品說明書用藥進(jìn)行管理與約束,可以有效避免藥品濫用行為,約束商業(yè)因素導(dǎo)致的超藥品說明書用藥,促進(jìn)開發(fā)新的藥品適應(yīng)證,使患者能用更低廉的費(fèi)用得到更加有效的醫(yī)療服務(wù),既保障醫(yī)療機(jī)構(gòu)及其從業(yè)人員合法的合理用藥權(quán)利,又保障患者健康權(quán)和知情權(quán),平衡醫(yī)患關(guān)系,構(gòu)建和諧社會。
[Abstract]:On the issue of superdrug instruction, domestic research is less concerned, academic foundation is relatively weak, lack of systematic theoretical basis and regulatory system. To promote domestic legislative research and system construction on the use of superdrug instructions, and to resolve the conflict between the behavior of medical institutions and their practitioners and the right to life and health of patients. This paper studies the legislative issues of drug use in superdrug instructions, collects periodicals, newspapers, and academic papers through school libraries, Internet electronic databases, China Law Retrieval system, and so on. The theoretical analysis of the problem is mainly divided into three parts: the first part, "the necessity of discussing the legislation of drug use in the superdrug specification", the author adopts the methods of literature research and case analysis. Starting from the legal problems caused by the drug instructions for the use of superdrugs, the reasons for the contradiction between the instructions for the use of drugs and the drug use are analyzed in detail. Then the key problem to be solved by law is to balance the doctor-patient relationship. The second part is "the domestic and foreign legal system of regulating the use of superdrug instructions". This paper clarifies the current situation of the legal regulation of drug use in China's superdrug instructions, introduces some foreign experiences and practices, and provides reference for the legislation of our country. The third part is "Construction of legal Regulation of Super-drug instructions". This part is based on law, medicine, etc. On the basis of the related theories of pharmacy and ethics, we should carry out cross-research from a multi-disciplinary point of view, select the level of legal effect, establish legal principles, construct specific contents, make clear the responsibility imputation, resolve legal disputes. The author believes that the National Health and Family Planning Commission should first formulate departmental regulations to deal with the problem of over-prescribing drugs. Establish a complete set of safeguards. This mechanism should cover the risk classification of drug specifications, the hierarchical informed consent process, the operation and monitoring procedures, and the establishment of standard-setting bodies. The conditions under which medical institutions and their employees can mitigate or exempt from legal liability, the improvement of the procedures for revising drug instructions, the legal liability that drug sales enterprises should bear for their propaganda materials, etc., and then gradually involving revision and perfection, Timely adjustment is made according to the changes in the social situation and the level of medical services, and when the conditions are ripe, they will be submitted to the State Council for the formulation of administrative laws and regulations. Through legislation to administer and restrict the use of drugs in excess of drug instructions, drug abuse can be effectively avoided. The restriction of commercial factors on the use of superdrug instructions promotes the development of new drug indications, enables patients to obtain more effective medical services at a lower cost, and ensures the legitimate and reasonable use of drugs by medical institutions and their practitioners. Protect the patient's right to health and right to know, balance the relationship between doctors and patients, and build a harmonious society.
