【摘要】：非商業(yè)性妊娠型代孕的倫理正當(dāng)性主要表現(xiàn)在對(duì)不孕方的最大關(guān)愛(ài)和尊重,對(duì)代孕母親和精卵捐獻(xiàn)者高尚品行的尊重、贊賞,其合法實(shí)施也能彌補(bǔ)現(xiàn)行法律缺位導(dǎo)致的實(shí)體正義缺失。由于對(duì)代孕不良倫理后果和權(quán)益糾紛的過(guò)度焦慮和夸大,合理的代孕行為被壓制和排斥在倫理正當(dāng)性和合法化之外,既使不孕者正常權(quán)益無(wú)法得到尊重和實(shí)現(xiàn),又使代孕母親和所生子女的倫理地位和利益在"地下"代孕情境中難以得到法律保障。因此,在我國(guó)以家庭倫理為本位和重視生兒育女的倫理語(yǔ)境下,通過(guò)妊娠型代孕合法化的政策實(shí)踐就能很好地解決代孕面臨的各種倫理、社會(huì)問(wèn)題。
[Abstract]:The ethical legitimacy of non-commercial pregnancy surrogacy is mainly manifested in the greatest care and respect for the infertile side, the respect for the noble conduct of the surrogate mother and the egg donor, and the appreciation for the noble conduct of the surrogate mother and the egg donor. Its legal implementation can also make up for the lack of substantive justice caused by the absence of existing laws. Due to the excessive anxiety and exaggeration of the adverse ethical consequences of surrogacy and disputes over rights and interests, reasonable surrogacy is suppressed and excluded from ethical legitimacy and legalization, even though the normal rights and interests of infertile persons cannot be respected and realized. It also makes the ethical status and interests of surrogate mother and children difficult to be protected by law in the "underground" surrogate situation. Therefore, in the ethical context of taking family ethics as the standard and attaching importance to giving birth to children, the policy practice of legalizing pregnancy surrogacy can solve all kinds of ethical and social problems faced by surrogacy.
