【摘要】：無(wú)罪推定體現(xiàn)了人權(quán)保障的價(jià)值。媒體報(bào)道彰顯了新聞自由的理念。媒體對(duì)案件的不當(dāng)報(bào)道會(huì)給獨(dú)立審判帶來(lái)不利影響,進(jìn)而損害被追訴人受無(wú)罪推定的權(quán)利。但司法獨(dú)立的完善配套制度具有保障獨(dú)立審判,抵御外來(lái)干涉的免疫功能,自由的媒體能夠進(jìn)行全方位、多角度的報(bào)道,具有保障私權(quán)、監(jiān)督公權(quán)的作用。"無(wú)罪推定"與"媒體報(bào)道"的關(guān)系實(shí)則是"人權(quán)保障""新聞自由"與"司法獨(dú)立"的緊張而又復(fù)雜的關(guān)系,西方對(duì)此早有討論并且做法各異。中國(guó)語(yǔ)境下的爭(zhēng)論雖持久不衰,但缺乏言說(shuō)的前提:自由的媒體與獨(dú)立的司法。
[Abstract]:The presumption of innocence embodies the value of human rights protection. Media reports highlight the idea of freedom of the press. Improper reporting of cases by the media will adversely affect the independent trial, and then impair the right of the accused to be presumed innocent. But the perfect supporting system of judicial independence has the function of safeguarding independent trial and resisting foreign interference. Free media can report from all directions and from many angles. It has the function of protecting private rights and supervising public rights. " The relationship between "presumption of innocence" and "media report" is in fact a tense and complex relationship between "human rights protection", "press freedom" and "judicial independence", which has long been discussed in the West. Although the debate in Chinese context is enduring, it lacks the premise of speech: free media and independent judicature.
