術(shù)語(yǔ)是現(xiàn)代科學(xué)的精髓,法律術(shù)語(yǔ)是法學(xué)的重要組成部分,法律術(shù)語(yǔ)的翻譯在法律文化交流中的作用不言而喻。法律翻譯最重要的問(wèn)題在于譯者如何解讀不同法律體系下的法律術(shù)語(yǔ)在異域語(yǔ)言中的傳達(dá)、創(chuàng)制,直到準(zhǔn)確無(wú)誤地將異域法律文化的法律術(shù)語(yǔ)轉(zhuǎn)化為目的語(yǔ)法律文化讀者所能接受的同等表達(dá)——即譯文術(shù)語(yǔ)。 文化交流及趨同已成為當(dāng)今社會(huì)的潮流。翻譯作為文化交流的主要方式,在兩種不同文化及語(yǔ)言之間架起了一座橋梁,文化因素的作用引起了越來(lái)越多翻譯者的注意。眾所周知,若從文化的角度來(lái)看翻譯,文化因素是翻譯過(guò)程中的主要障礙,文化內(nèi)涵豐富的法律翻譯也不能例外。由此,本文嘗試討論及解決文化因素給法律術(shù)語(yǔ)翻譯所帶來(lái)的困難。 本文主要由兩部分構(gòu)成。第一部分對(duì)文化因素在法律術(shù)語(yǔ)翻譯中的體現(xiàn)進(jìn)行了系統(tǒng)、詳盡的分析,并提出所涉及的文化因素主要包括社會(huì)制度、法律體系、法制功能、法律制度及程序、法律文化傳統(tǒng)、文化心理和思維方式的差異,從而揭示了法律翻譯時(shí)譯者所面臨的問(wèn)題。第二部分旨在提出解決法律翻譯過(guò)程中的文化因素差異應(yīng)遵循的原則和策略。
