中國近期有關法律翻譯的研究大都集中在法律翻譯的微觀語言層面,法律翻譯僅僅被看作是語言符號的轉(zhuǎn)換過程。鑒于此,本文以法國社會學家、人類學家布迪厄的文化生產(chǎn)理論為基礎,借用場域、資本、生存心態(tài)、象征性權力、權力正當化等核心概念,探究法律語篇的社會根源和社會功能,研究法律語篇的象征性權力及其翻譯。權力不是用強制性的暴力來維持與鞏固的,而是借助象征性中介進入人們的生存心態(tài),指導人們的社會實踐,在這種象征性實踐中被承認,從而實現(xiàn)自身的合法化與正當化。語言運用技巧與權力運用策略緊密相連,機構化的語言更是權力策略的象征性體現(xiàn)。作為機構化的法律語篇,其特有的語言特點正是象征性權力的表現(xiàn),是權力正當化的一種有效方式。本文以《中華人民共和國義務教育法》為例,透析蘊含在法律語篇中的象征性權力,解析體現(xiàn)這一象征性權力的語言特點,探析翻譯法律語篇的策略。本文以社會學視角探析法律語篇的特點及其翻譯,宏觀與微觀相結合,為法律翻譯研究提供了新的理論視角,對從事法律翻譯實踐的工作者有一定的指導意義。
