【摘要】：本文以真實的庭審會話為語料,運用話語立場、話語分析的理論方法對法官的話語立場問題展開研究,逐層分析法官話語立場的類型、表達方式和規(guī)范問題。全文共分為五個部分:第一部分是緒論,包括研究內(nèi)容、研究意義、研究現(xiàn)狀、研究方法和語料說明。第二部分主要研究法官話語立場的類型。首先將法官的話語立場劃分為評價立場、情感立場、認識立場和(非)一致性立場四類,然后對每一類型分別論述:法官評價,是用價值標準衡量訴訟參與人行為的活動,包括肯定評價和否定評價;法官情感,是法官對于案件中人事物的傾向性反應(yīng),包括積極情感和消極情感兩類;法官認識,是法官對所獲信息的認知,包括經(jīng)驗型認識和知識型認識;法官的(非)一致性,是指對前話人觀點的認同或不認同,包括一致性和不一致性。第三部分主要考察法官話語立場的表達方式�？疾彀l(fā)現(xiàn),法官的評價立場主要有詞匯、問話和轉(zhuǎn)述三種表達方式;情感立場主要運用描述和反問兩種表達方式;認識立場主要通過推斷和引證表達;(非)一致性立場的表達,法官主要運用打斷、重復(fù)、控題三種方式。第四部分主要探討法官話語立場的規(guī)范問題。制度層面上,將“法官中立”確立為法律基本原則,落實回避制度、完善法官職業(yè)道德制度,加強規(guī)定力度;完善法官薪酬制度和審判獨立制度,降低外部環(huán)境影響;建立“庭審直播”制度,形成監(jiān)督常態(tài)。話語層面上,在評價立場、情感立場、認識立場、(非)一致性立場的表達上,做到合理合法。第五部分是結(jié)語,對全文進行總結(jié),主要包括研究成果、創(chuàng)新之處和不足之處。
[Abstract]:This paper takes the real trial session as the corpus, uses the discourse standpoint, the discourse analysis theory method to carry on the research to the judge's discourse position question, analyzes the judge's discourse position type, the expression way and the standard question layer by layer. The paper is divided into five parts: the first part is the introduction, including the research content, research significance, research status, research methods and corpus description. The second part mainly studies the types of judges' discourse positions. First of all, judges' discourse positions are divided into four categories: evaluation position, emotional position, cognitive position and (non-consistency) position, and then discusses each type separately: judge evaluation is a measure of the activities of litigation participants' behavior by the standard of value. Including positive evaluation and negative evaluation; judge emotion is the judge's tendentious reaction to the human matter in the case, including positive emotion and negative emotion; judge cognition, is judge's cognition to the information obtained, The judge's (non-consistency) refers to the recognition or disapproval of the former speaker's viewpoint, including consistency and inconsistency. The third part mainly studies the expression of the judge's discourse position. It is found that judges' evaluation positions are mainly composed of three expressions: vocabulary, questioning and reporting; affective positions are mainly expressed by description and counter-questioning; cognitive positions are mainly expressed by inference and citation; (non-consistent positions) are expressed. The judge mainly uses three ways of interrupting, repeating and controlling questions. The fourth part mainly discusses the normative issues of judges' discourse position. On the system level, we should establish "the neutrality of judges" as the basic principle of law, implement the system of recusal, perfect the system of judges' professional ethics, strengthen the regulation, perfect the system of judges' compensation and judicial independence, and reduce the influence of external environment. Establish the system of "live trial" and form the normal state of supervision. At the discourse level, it is reasonable and legal to express the evaluation position, the emotional position, the cognitive position and the (non -) consistent position. The fifth part is the conclusion, summarizes the full text, mainly includes the research result, the innovation and the deficiency.
