【摘要】：法律和語言緊密相關(guān)。刑事判決書是人民法院依照刑事訴訟法規(guī)定的程序,對刑事案件審理終結(jié),根據(jù)查明的事實(shí)和證據(jù),依法對被告人定罪量刑的書面決定,是刑事審判過程中的重要環(huán)節(jié)之一。其不僅反映了判決的法律效力,更展示了法官與訴訟人之間的文本交際。本文以Mann和Thompson等提出的修辭結(jié)構(gòu)理論為依據(jù),對30篇中文刑事判決書中修辭關(guān)系進(jìn)行全面的標(biāo)注,然后采取定性和定量相結(jié)合的方法進(jìn)行修辭關(guān)系的分析,旨在探討刑事判決書各個語步中修辭關(guān)系分布的異同及特點(diǎn),研究不同修辭關(guān)系在中文刑事判決書中的功能。本文由七個部分組成。第一章為引言部分,主要陳述了本文的研究背景、研究目的、研究意義等。第二章是文獻(xiàn)綜述,主要回顧了修辭結(jié)構(gòu)理論以及法庭判決書在國內(nèi)外的研究現(xiàn)狀。第三章為本文的理論框架,簡述了修辭結(jié)構(gòu)理論和判決書語步的具體內(nèi)容。第四章闡述了本文的研究方案,包括研究的語料、研究步驟和研究的具體方法。第五章分析了各種修辭關(guān)系在中文刑事判決書中的語言實(shí)現(xiàn)。第六章為討論結(jié)果部分,主要分析了修辭關(guān)系在中文刑事判決書各個語步中的分布和特點(diǎn),并有針對性的分析了中文刑事判決書中最常用的修辭關(guān)系。第七章概括性陳述了本文的結(jié)論以及研究的局限性和啟示。本文發(fā)現(xiàn)中文刑事判決書中包含豐富的修辭關(guān)系。序列關(guān)系以及聯(lián)結(jié)關(guān)系出現(xiàn)次數(shù)極多,在多核心修辭關(guān)系中共占95%左右。在核心-衛(wèi)星類關(guān)系中,環(huán)境關(guān)系、闡述關(guān)系、意愿性結(jié)果關(guān)系和意愿性原因關(guān)系出現(xiàn)次數(shù)最多。就中文判決書不同語步而言,修辭關(guān)系分布有巨大差異。環(huán)境關(guān)系、闡述關(guān)系和序列關(guān)系在告知性語步中占優(yōu)勢,而意愿性原因、意愿性結(jié)果關(guān)系和聯(lián)結(jié)關(guān)系在表達(dá)觀點(diǎn)的語步中占優(yōu)勢。此外,不同修辭關(guān)系所起作用也不盡相同。聯(lián)結(jié)關(guān)系、序列關(guān)系和闡述關(guān)系使得判決書條理更清晰、語言更連貫,而證明關(guān)系、原因結(jié)果類關(guān)系和解釋關(guān)系使得判決書更有信服力、更有邏輯性且更加詳細(xì)。本文以修辭結(jié)構(gòu)理論為依據(jù),對中文刑事判決書中修辭關(guān)系進(jìn)行分析,不僅豐富了基于修辭結(jié)構(gòu)理論指導(dǎo)下的法律文本研究,還能為法律學(xué)者們對判決書的寫作和評鑒提供一些思路,希望能為我國判決書的改革提供一些參考。
[Abstract]:Law and language are closely related. Criminal judgment is a written decision of the people's court in accordance with the procedure prescribed by the Criminal procedure Law, which ends the trial of a criminal case, and is one of the important links in the process of criminal trial, according to the facts and evidence found out, and the written decision on the conviction and sentencing of the defendant according to the law. It not only reflects the legal effect of the judgment, but also shows the text communication between the judge and litigants. Based on the rhetorical structure theory put forward by Mann and Thompson, this paper comprehensively annotates the rhetorical relations in 30 Chinese criminal judgments, and then analyzes the rhetorical relations by combining qualitative and quantitative methods. The purpose of this paper is to explore the similarities and differences in the distribution of rhetorical relations in each step of the criminal judgment, and to study the functions of different rhetorical relations in the Chinese criminal judgment. This paper consists of seven parts. The first chapter is the introduction, mainly describes the research background, research purpose, research significance and so on. Chapter two is a literature review, which reviews the theory of rhetorical structure and the research status of court judgments at home and abroad. The third chapter is the theoretical framework of this paper, briefly describes the rhetorical structure theory and the specific content of sentence steps. The fourth chapter describes the research program, including the research corpus, research steps and research methods. Chapter five analyzes the realization of various rhetorical relations in Chinese criminal judgment. The sixth chapter is the result of the discussion, mainly analyzes the distribution and characteristics of rhetorical relations in each step of the Chinese criminal judgment, and analyzes the most commonly used rhetorical relations in the Chinese criminal judgment. The seventh chapter summarizes the conclusions of this paper and the limitations and implications of the study. This paper finds that the Chinese criminal judgment contains rich rhetorical relations. Sequence relation and connection relation appear frequently, accounting for about 95% of the multi-core rhetorical relations. In the core-satellite relationship, the environmental relationship, the expounding relationship, the willing result relationship and the willing cause relationship appear most frequently. There are great differences in the distribution of rhetorical relations among different steps in Chinese judgments. Environmental relation, expounding that relationship and sequence relation are dominant in informing language step, while willing reason, willing result relation and connection relation are dominant in expressing point of view. In addition, different rhetorical relationships play different roles. The connection relation, the sequence relation and the elaboration relation make the judgement more clear and the language more coherent, while the relation of proof, the relation of reason and result and the relation of explanation make the judgment more convincing, more logical and more detailed. Based on the theory of rhetorical structure, this paper analyzes the rhetorical relations in Chinese criminal judgments, which not only enriches the study of legal texts under the guidance of rhetorical structure theory. It can also provide some ideas for the legal scholars to write and evaluate the judgments, hoping to provide some references for the reform of the judgments in our country.
