【摘要】：非物質文化遺產(chǎn)是各民族世代相承的、與群眾生活密切相關的各種傳統(tǒng)文化表現(xiàn)形式和文化空間。它與物質文化遺產(chǎn)一樣共同承載著人類社會的文明。但是最近幾年,隨著全球化趨勢的加強和現(xiàn)代化進程的加快,我國的非物質文化遺產(chǎn)受到了巨大的沖擊,一些依靠口授和行為傳承的文化遺產(chǎn)正在不斷地消亡。 就對非物質文化遺產(chǎn)的法律保護機制而言,長期以來沒有形成完備的法律保障體系。雖然《中華人民共和國非物質文化遺產(chǎn)保護法》已經(jīng)頒布,但是這部法律主要側重于公法保護,當前對非物質文化遺產(chǎn)法律保護的研究仍然具有重要的意義。作者選取了自己比較熟悉的豫劇入手,通過運用比較分析法、田野調查法、個案分析等方法來對豫劇的法律保護進行了探討。 本文共分導論、第一章至第四章。導論主要從研究意義、研究現(xiàn)狀、研究方法、文章主要內容和創(chuàng)新、文章不足等方面進行了歸納。第一章非物質文化遺產(chǎn)概述分三節(jié)對非物質文化遺產(chǎn)的基本內容作了介紹,第一節(jié)主要介紹了非物質文化遺產(chǎn)的含義和基本特點；第二節(jié)從非物質文化遺產(chǎn)的價值入手,論證了保護非物質文化遺產(chǎn)的必要性。第三節(jié)主要討論了對非物質文化遺產(chǎn)的法律保護模式的選擇。第一章為后面探討法律保護問題做了鋪墊。第二章豫劇法律保護的現(xiàn)狀,這一章主要介紹了目前豫劇的生存狀態(tài)和法律保護的不足,同時仔細地分析了其產(chǎn)生的原因。第三章和第四章是文章的重點,第三章分為兩部分,分別從行政保護機制、民事保護機制對豫劇的保護提出了自己的建議。第四章從豫劇保護的具體制度研究和豫劇保護的特殊制度保護者兩方面完善了豫劇保護機制。
[Abstract]:Intangible cultural heritage is a variety of traditional cultural expressions and cultural spaces that are inherited from generation to generation and are closely related to the lives of the masses. It carries the civilization of human society as well as material cultural heritage. However, in recent years, with the strengthening of globalization and the acceleration of modernization, the intangible cultural heritage of our country has been greatly impacted, and some cultural heritage, which depends on dictation and behavior inheritance, is dying out. As far as the legal protection mechanism of intangible cultural heritage is concerned, a complete legal protection system has not been formed for a long time. Although the Law of the people's Republic of China on the Protection of Intangible Cultural Heritage has been promulgated, this law mainly focuses on the protection of public law, and the current research on the legal protection of intangible cultural heritage is still of great significance. The author selects the Henan opera which he is familiar with, and probes into the legal protection of the Henan opera by using the methods of comparative analysis, field investigation and case analysis. This paper is a co-introduction, chapters I to IV. The introduction mainly summarizes the research significance, research status, research methods, the main content and innovation of the article, the deficiency of the article and so on. The first chapter introduces the basic contents of intangible cultural heritage in three sections, the first section mainly introduces the meaning and basic characteristics of intangible cultural heritage, and the second section demonstrates the necessity of protecting intangible cultural heritage from the value of intangible cultural heritage. The third section mainly discusses the choice of legal protection mode of intangible cultural heritage. The first chapter paves the way for the later discussion of legal protection. The second chapter is the present situation of the legal protection of Henan Opera, which mainly introduces the living state and the deficiency of legal protection of Henan Opera at present, and carefully analyzes the causes of its emergence. The third chapter and the fourth chapter are the focus of the article, the third chapter is divided into two parts, respectively, from the administrative protection mechanism, civil protection mechanism to the protection of Henan opera put forward their own suggestions. The fourth chapter perfects the protection mechanism of Henan opera from two aspects: the specific system research of Henan opera protection and the special system protector of Henan drama protection.
