【摘要】：與我國社會經(jīng)濟的快速發(fā)展、居民物質(zhì)水平與生活品位的顯著提高相適應(yīng)，人們對室內(nèi)環(huán)境的要求也不再是滿足最基本的工作、居住等需求，而是向著舒適、高雅的標(biāo)準(zhǔn)邁進。與這一要求相適應(yīng)，室內(nèi)裝修迅速普及開來。一方面，對室內(nèi)進行裝修能夠在一定程度上滿足不同人群的不同心理需求，使室內(nèi)環(huán)境更加舒適高雅和個性化；另一方面，裝修導(dǎo)致的室內(nèi)污染卻相伴而生，近幾年來裝修污染在室內(nèi)環(huán)境污染中所占比例不斷攀升，并最終成為導(dǎo)致室內(nèi)環(huán)境污染的首要因素。這種現(xiàn)象不僅發(fā)生在我國，而是普遍存在于世界范圍內(nèi)，室內(nèi)裝修污染的危害已經(jīng)受到全世界的廣泛關(guān)注，不少國家已采取多種措施減少其對民眾生活的危害。目前，我國缺少具體規(guī)范室內(nèi)裝修污染行為的法律法規(guī)，現(xiàn)有的規(guī)定主要集中在各相關(guān)部門頒布的環(huán)境標(biāo)準(zhǔn)上，加之政府職能部門對室內(nèi)裝修行業(yè)各環(huán)節(jié)管理不到位及普通民眾環(huán)保和法律意識不強，出現(xiàn)了大量的室內(nèi)裝修污染致人損害案件。加之我國室內(nèi)裝修污染損害賠償法律救濟制度不完善，在司法實踐中這些案件的判決結(jié)果并不能很好地維護受害者的合法權(quán)益，，怎樣使室內(nèi)裝修污染受害人的損害得到合理賠償是當(dāng)前亟需解決的問題。本文試從室內(nèi)裝修污染的概念、特點、現(xiàn)狀及損害行為的原因出發(fā)進行分析，結(jié)合當(dāng)前我國室內(nèi)裝修污染損害賠償法律制度的相關(guān)規(guī)定及不足，對如何建立完善的室內(nèi)裝修污染損害賠償法律制度提出自己的些許觀點和建議，希望這些觀點和建議對于室內(nèi)裝修污染損害賠償法律制度的建立和完善來說不僅具有一定的理論價值，并且在司法實踐中也能具有較強的實際操作性。
[Abstract]:With the rapid development of our country's social economy and the remarkable improvement of residents' material level and living grade, people's demand for indoor environment is no longer to meet the most basic needs, such as work and residence, but to the standard of comfort and elegance. In line with this requirement, interior decoration quickly spread. On the one hand, the interior decoration can meet the different psychological needs of different people to a certain extent, make the indoor environment more comfortable and elegant and personalized; on the other hand, the indoor pollution caused by decoration is accompanied by, In recent years, the proportion of decoration pollution in indoor environmental pollution has been rising, and finally become the primary factor leading to indoor environmental pollution. This phenomenon occurs not only in our country, but also in the whole world. The harm of indoor decoration pollution has been paid more and more attention all over the world. Many countries have taken various measures to reduce the harm to people's life. At present, China lacks specific laws and regulations to regulate indoor decoration pollution, and the existing regulations mainly focus on the environmental standards promulgated by the relevant departments. In addition, the government departments do not manage the various links of the interior decoration industry in place, and the ordinary people do not have a strong sense of environmental protection and law, there are a large number of indoor decoration pollution caused damage cases. In addition, the legal relief system for indoor decoration pollution damage compensation is not perfect in our country. In judicial practice, the adjudication results of these cases can not protect the legitimate rights and interests of the victims. How to get reasonable compensation for the damage caused by indoor decoration pollution is an urgent problem. This paper tries to analyze the concept, characteristics, present situation and causes of damage behavior of indoor decoration pollution, combining with the relevant regulations and deficiencies of the current legal system of compensation for indoor decoration pollution damage in our country. Some opinions and suggestions on how to establish a perfect legal system of indoor decoration pollution damage compensation are put forward. It is hoped that these viewpoints and suggestions not only have certain theoretical value for the establishment and perfection of the legal system of indoor decoration pollution damage compensation, but also have strong practical operation in judicial practice.
