【摘要】： 室內(nèi)裝修污染是一種典型的環(huán)境侵權(quán)行為。它是因產(chǎn)業(yè)活動或其他人為原因,致生環(huán)境介質(zhì)的污染或破壞,并因而對他人人身權(quán)和財產(chǎn)權(quán)造成損害或有造成損害之虞,依法應(yīng)當(dāng)承擔(dān)民事責(zé)任的行為。環(huán)境侵權(quán)并不等同于侵害環(huán)境權(quán),環(huán)境侵權(quán)的客體是人身權(quán)和財產(chǎn)權(quán),不包括環(huán)境權(quán)。侵害環(huán)境權(quán)是指破壞環(huán)境生態(tài)功能,從而構(gòu)成對環(huán)境生態(tài)功能的損害,侵害了自然人享有適宜自身生存和發(fā)展的良好環(huán)境的法律權(quán)利。在裝修賠償法律關(guān)系中,賠償權(quán)利人可以違約或侵權(quán)為基礎(chǔ)行使請求權(quán),賠償權(quán)利人為受害人,在可以以違約或侵權(quán)為請求權(quán)基礎(chǔ),要求賠償義務(wù)人承擔(dān)損害賠償責(zé)任。在具體的賠償制度中,應(yīng)當(dāng)注重賠償法律關(guān)系的主體、客體、損害賠償?shù)臉?gòu)成、損害賠償?shù)姆椒�、范圍、原則、計算等基礎(chǔ)問題,鑒于目前我國民事侵權(quán)損害賠償制度的不足,應(yīng)當(dāng)從四個方面來完善之:一是在立法上制定一部統(tǒng)一的民事侵權(quán)賠償法;二是將環(huán)境污染受害人納入社會救助體系;三是建立環(huán)境污染責(zé)任保險制度;四是開征環(huán)境稅。
[Abstract]:Indoor decoration pollution is a typical environmental tort. It is caused by pollution or destruction of environmental media due to industrial activities or other man-made reasons, and thus damage or damage to the personal and property rights of others. The object of environmental tort is the personal right and property right, not including the environmental right. The infringement of environmental right means to destroy the ecological function of the environment, and the environmental tort is not equal to the infringement of the environmental right, and the object of the environmental tort is the personal right and the property right, not including the environmental right. As a result, the damage to the ecological function of the environment has infringed upon the legal right of natural persons to enjoy a good environment suitable for their own survival and development. In the legal relationship of decoration and compensation, the obligee of compensation can breach the contract or infringe on the basis of which he can exercise his right of claim. If the obligee of compensation is the victim, he may demand the obligor to bear the liability for damages on the basis of breach of contract or tort. In the specific compensation system, attention should be paid to the subject and object of the legal relationship of compensation and the constitution of the compensation for damages. The method, scope, principle, calculation and other basic problems of compensation for damages should be improved from four aspects in view of the deficiency of the current system of compensation for tort damages in our country: first, to formulate a unified civil tort compensation law in legislation; The second is to bring the victims of environmental pollution into the social relief system, the third is to establish the liability insurance system for environmental pollution, and the fourth is to levy environmental tax.
