【摘要】：近年來,由裝修引起的室內(nèi)環(huán)境污染頻繁發(fā)生,許多消費者深受其害。室內(nèi)裝修污染嚴(yán)重侵害了居住人的生命權(quán)、健康權(quán)、財產(chǎn)權(quán),裝修糾紛的日益增多,使得裝修污染已經(jīng)成為人們關(guān)注的一個熱點問題。 本文正文共分五個部分,第一部分主要是緒論,主要論述本文的選題背景、目的、意義及國內(nèi)外發(fā)展現(xiàn)狀等基本問題。第二部分是室內(nèi)裝修污染概述,對室內(nèi)裝修污染的基本問題,如概念、特征、分類及危害進行了簡單的論述。第三部分從侵權(quán)角度出發(fā),依據(jù)侵權(quán)責(zé)任的基本原理,具體到裝修污染個案,根據(jù)侵權(quán)行為構(gòu)成要件的不同,侵權(quán)人承擔(dān)產(chǎn)品責(zé)任或環(huán)境侵權(quán)責(zé)任,結(jié)合現(xiàn)實生活中裝修污染實際情形,作了具體責(zé)任分析。第四部分首先對我國室內(nèi)裝修污染侵權(quán)損害賠償?shù)南嚓P(guān)法律規(guī)定進行了歸納；其次總結(jié)了我國室內(nèi)裝修污染侵權(quán)損害賠償存在的基本問題,這些問題主要表現(xiàn)在：室內(nèi)裝修污染侵權(quán)損害賠償?shù)牧⒎w系不夠完善且缺乏可操作性,各部門所頒布的環(huán)境標(biāo)準(zhǔn)存在缺陷,室內(nèi)裝修污染環(huán)境侵權(quán)責(zé)任認(rèn)定困難,現(xiàn)行的賠償原則導(dǎo)致賠償數(shù)額低,精神損害賠償應(yīng)用率低,缺乏社會化的救濟措施等。這一系列的問題不僅導(dǎo)致受害人的合法權(quán)益得不到充分救濟,更不能很好的體現(xiàn)法律倡導(dǎo)的公平正義原則。第五部分主要針對第四部分存在的問題,提出具體的完善措施,這些措施主要包括：一是完善現(xiàn)行立法體系,保障室內(nèi)裝修污染有法可依；二是完善裝修污染侵權(quán)責(zé)任認(rèn)定,分兩點：適用因果關(guān)系推定及明確裝修污染侵權(quán)責(zé)任認(rèn)定標(biāo)準(zhǔn)；三是強化精神損害賠償?shù)倪m用；四是引入懲罰性賠償；五是實現(xiàn)裝修污染損害賠償?shù)纳鐣?具體表現(xiàn)為建立裝修污染責(zé)任保險制度和室內(nèi)環(huán)境污染補償金。
[Abstract]:In recent years, indoor environmental pollution caused by decoration occurs frequently, and many consumers suffer from it. Indoor decoration pollution seriously infringes upon the residents' right to life, health, property and decoration disputes. So that decoration pollution has become a hot issue that people pay attention to. The text of this paper is divided into five parts, the first part is the introduction, mainly discusses the background, purpose, significance and domestic and international development of the basic issues. The second part is an overview of indoor decoration pollution. The basic problems of indoor decoration pollution, such as concept, characteristics, classification and harm, are briefly discussed. The third part is from the perspective of tort, according to the basic principles of tort liability, specific to decoration pollution cases, According to the different elements of tort, the infringer bears product liability or environmental tort liability, combined with the actual situation of pollution caused by decoration in real life, In the 4th part, the author summarizes the relevant laws and regulations of the tort compensation for indoor decoration pollution in China, and then summarizes the basic problems existing in the compensation for indoor decoration pollution tort damages in China. These problems are mainly manifested in: the legislative system of indoor decoration pollution tort compensation is not perfect and lack of maneuverability, the environmental standards promulgated by various departments are defective, and it is difficult to identify the tort liability of indoor decoration pollution environment. The current principle of compensation leads to a low amount of compensation, a low application rate of compensation for mental damage, a lack of socialized relief measures, etc. These problems not only lead to insufficient relief for the legitimate rights and interests of the victims, The 5th part mainly aims at the problems existing in part 4th, and puts forward specific measures to perfect them. These measures mainly include: first, to perfect the current legislative system, The second is to perfect the tort liability identification of decoration pollution, which is divided into two points: to apply causality presumption and define the standard of tort liability for decoration pollution; third, to strengthen the application of compensation for mental damage; The fourth is to introduce punitive damages, and the fifth is to realize the socialization of decoration pollution damages, which is manifested in the establishment of decoration pollution liability insurance system and indoor environmental pollution compensation.
