動(dòng)漫形象商品化法律規(guī)制研究

【摘要】:動(dòng)漫形象以其公眾影響力而為眾商家所青睞,被廣泛的應(yīng)用于各種產(chǎn)品上,此即動(dòng)漫形象的商品化。由此而產(chǎn)生的權(quán)利為動(dòng)漫形象商品化權(quán),然而該權(quán)利還僅僅存在法理上,即使在商品化權(quán)理論研究較先進(jìn)之美、日國(guó)家也沒(méi)有將商品化權(quán)以立法形式規(guī)定下來(lái)。緣由于該權(quán)利之客體、保護(hù)范圍、性質(zhì)都未成定論,因此各國(guó)在司法實(shí)踐上多以知識(shí)產(chǎn)權(quán)法體系并輔以反不正當(dāng)競(jìng)爭(zhēng)法加以保護(hù)。然而隨著商品化現(xiàn)象的不斷擴(kuò)展,商品化權(quán)研究的不斷深入,現(xiàn)今立法范圍的保護(hù)模式越來(lái)越呈現(xiàn)出局限性。故此,筆者以動(dòng)漫形象商品化權(quán)存在之合理性為思考基點(diǎn),運(yùn)用比較分析的方法對(duì)動(dòng)漫形象商品化現(xiàn)象進(jìn)行研究。全文分為五個(gè)部分: 導(dǎo)言部分介紹了我國(guó)動(dòng)漫產(chǎn)業(yè)發(fā)展的現(xiàn)狀和提出我國(guó)動(dòng)漫形象商品化市場(chǎng)發(fā)展不充分,法律規(guī)制不足等問(wèn)題,確認(rèn)研究動(dòng)漫形象商品化權(quán)的必要性。 第一章主要介紹動(dòng)漫、動(dòng)漫產(chǎn)業(yè)的概況,動(dòng)漫形象的內(nèi)涵定位,商品化的概念、動(dòng)漫形象商品化的現(xiàn)象,并從經(jīng)濟(jì)學(xué)角度闡述動(dòng)漫產(chǎn)業(yè)給國(guó)家經(jīng)濟(jì)所帶來(lái)的重大影響,其主旨即在于引出動(dòng)漫形象商品化法律規(guī)制之必要性及動(dòng)漫形象商品化權(quán)研究之必要性。 第二章從司法實(shí)踐角度引用各國(guó)經(jīng)典案例來(lái)比較分析各國(guó)對(duì)動(dòng)漫形象商品化的立法保護(hù)模式,重點(diǎn)分析我國(guó)現(xiàn)今立法保護(hù)模式上的不足,為立法之完善提供著眼點(diǎn)。 第三章從理論研究角度分析“商品化權(quán)”,探討其權(quán)利內(nèi)涵,重點(diǎn)分析其與相關(guān)知識(shí)產(chǎn)權(quán)的區(qū)別,從而確立商品化權(quán)獨(dú)立存在的可行性,同時(shí)也明確商品化權(quán)理論存在的諸多問(wèn)題,如范圍不明、性質(zhì)不清等。在此基礎(chǔ)上,對(duì)動(dòng)漫形象商品化權(quán)進(jìn)行權(quán)利定位,確立其“新型知識(shí)產(chǎn)權(quán)”的性質(zhì),從而為下文之法律完善提供理論依據(jù)。 第四章為立法建議,通過(guò)司法實(shí)踐及理論上對(duì)動(dòng)漫形象商品化權(quán)的探討,筆者建議延緩商品化權(quán)單獨(dú)立法,而以完善現(xiàn)今立法的形式達(dá)到保護(hù)動(dòng)漫形象這一特定對(duì)象之商品化權(quán)的目的。 結(jié)語(yǔ)部分筆者對(duì)動(dòng)漫形象商品化的法律保護(hù)立法模式進(jìn)行了系統(tǒng)的總結(jié),認(rèn)為應(yīng)該遵循一個(gè)循序漸進(jìn)的過(guò)程。
[Abstract]:Animation image is favored by many merchants because of its public influence, and is widely used in various products, that is, commoditization of animation image. The right arising from this is the right of commoditization of animation image, but the right has only legal theory. Even in the theory of commoditization right, Japan has not stipulated the right of commoditization in the form of legislation. As the object, scope and nature of this right have not been decided, many countries use intellectual property law system and anti-unfair competition law to protect it in judicial practice. However, with the continuous expansion of commercialization and the deepening of the research on the right of commercialization, the protection mode of the scope of legislation is becoming more and more limited. Therefore, the author uses the method of comparative analysis to study the phenomenon of animation image commercialization based on the rationality of the existence of animation image commercialization right. The full text is divided into five parts: The introduction part introduces the current situation of animation industry development in China and points out that the market development of animation image commercialization in our country is not sufficient and the legal regulation is insufficient to confirm the necessity of studying the right of commoditization of animation image. The first chapter mainly introduces the animation, the animation industry general situation, the animation image connotation localization, the commercialization concept, the animation image commercialization phenomenon, and from the economic angle elaborated the animation industry to the national economy significant influence, The purpose is to draw the necessity of legal regulation of commoditization of animation image and the necessity of research on commercialization right of animation image. The second chapter from the point of view of judicial practice to cite the classic cases of countries to compare and analyze the animation image commercialization of the legislative protection model, focusing on the shortcomings of our current legislative protection model, to provide a focus for the perfection of legislation. The third chapter analyzes the "right of commercialization" from the angle of theoretical research, discusses the connotation of the right, and analyzes the difference between the right and the relevant intellectual property, so as to establish the feasibility of the independent existence of the right of commercialization. At the same time, it is clear that there are many problems in the theory of commercialization right, such as unclear scope and unclear nature. On this basis, the right to commercialize the animation image is positioned to establish the nature of its "new intellectual property", thus providing a theoretical basis for the legal perfection below. The fourth chapter is the legislative suggestion, through the judicial practice and the theory discussion to the animation image commercialization right, the author suggests postponing the commercialization right separately legislation, The purpose of protecting the commercialization right of the specific object is to perfect the present legislation. In the conclusion part, the author summarizes the legal protection legislation model of commoditization of animation image systematically, and thinks that we should follow a gradual process.
