KPO中的知識產(chǎn)權(quán)風(fēng)險及其控制

【摘要】:知識流程外包(Knowledge Process Outsourcing,簡稱KPO)作為知識密集型產(chǎn)業(yè)與知識產(chǎn)權(quán)密切相關(guān)。而在我國,據(jù)調(diào)查,我國的知識流程外包產(chǎn)業(yè)的發(fā)展尚處于初級狀態(tài),而創(chuàng)意產(chǎn)業(yè)的知識產(chǎn)權(quán)建設(shè)也并未完善。于是本文在分析了知識流程外包中的知識產(chǎn)權(quán)授權(quán)主體的基礎(chǔ)上,提出了我國KPO產(chǎn)業(yè)中的知識產(chǎn)權(quán)的授權(quán)模式和各種模式的價值估值體系來控制知識流程外包中的知識產(chǎn)權(quán)風(fēng)險,并對通過對調(diào)研的知識流程外包產(chǎn)業(yè)——易唯思中國商務(wù)咨詢有限公司的知識產(chǎn)權(quán)授權(quán)模式進(jìn)行了具體剖析。本文通過對KPO產(chǎn)業(yè)中知識產(chǎn)權(quán)授權(quán)模式的研究和分析,希望能給這個新興的領(lǐng)域以借鑒。 本文主要解決的關(guān)鍵問題有:提出KPO的知識產(chǎn)權(quán)風(fēng)險問題及控制方法。由于KPO中發(fā)包方與接包方存在知識共享,使得發(fā)包方將自身核心技術(shù)和知識暴露給其合作伙伴接包方。這使得知識流程外包可能面臨著知識產(chǎn)權(quán)流失;知識產(chǎn)權(quán)權(quán)益分配不公;知識產(chǎn)權(quán)不正當(dāng)競爭和知識資源被掠奪等產(chǎn)權(quán)風(fēng)險。本論文通過KPO中知識產(chǎn)權(quán)風(fēng)險產(chǎn)生原因和機(jī)理的分析,將知識產(chǎn)權(quán)風(fēng)險劃分為知識產(chǎn)權(quán)流失風(fēng)險、侵犯第三方知識產(chǎn)權(quán)風(fēng)險以及知識產(chǎn)權(quán)歸屬風(fēng)險。面對這些風(fēng)險,我提出了一系列控制辦法,其中KPO中的知識產(chǎn)權(quán)授權(quán)模式控制機(jī)制是我提出的最實用的控制風(fēng)險的方法,即:無限授權(quán)模式(unlimited);按實際使用收費(fèi)授權(quán)模式(pay-per-use);按需擴(kuò)容授權(quán)模式(capacity-on-demand);谑跈(quán)模式的選擇方,我也提出了相應(yīng)的:風(fēng)險因子分析、收益因子分析、調(diào)整和適應(yīng)能力分析和激勵強(qiáng)度分析,以協(xié)助KPO運(yùn)營者從風(fēng)險、收益、調(diào)整和適應(yīng)能力、以及激勵強(qiáng)度等各方面,分析出最適合自己的授權(quán)模式。 文章第一部分向讀者介紹KPO的概念范疇,以及KPO區(qū)別于其他外包形式的與知識產(chǎn)權(quán)有關(guān)的典型特征。 第二部分,提出可以用來識別KPO中知識產(chǎn)權(quán)風(fēng)險的分析依據(jù)、分析模型,使得后文的分析結(jié)果更準(zhǔn)確,更有說服性。并結(jié)合之前我在做新世紀(jì)人才項目中跟蹤調(diào)查的江通動漫的案例,分析KPO中主要涉及的知識產(chǎn)權(quán)類型,并進(jìn)行總結(jié)歸納,形成風(fēng)險框架。 第三部分是搜集歸納我們信息管理專業(yè)的典型的分析方法,然后提煉得出能夠用于KPO中知識產(chǎn)權(quán)風(fēng)險識別的分析模型和方法,并進(jìn)行可行性判斷,然后結(jié)合上面的分析方法,得到KPO中存在的知識產(chǎn)權(quán)風(fēng)險。 第四部分是在提出風(fēng)險的基礎(chǔ)上,結(jié)合我去年一整年,在導(dǎo)師的新世紀(jì)人才項目中做的這方面的研究,得出除了采取相關(guān)知識產(chǎn)權(quán)法的大眾化控制方法外,運(yùn)用我歸納的知識產(chǎn)權(quán)授權(quán)模式,采取合理的知識產(chǎn)權(quán)授權(quán)機(jī)制,是KPo中風(fēng)險控制最有效的途徑。 最后一個部分則是運(yùn)用我們之前一直在跟蹤調(diào)查的一個典型的國內(nèi)KPO企業(yè)的實例,將上述風(fēng)險控制模型在企業(yè)中的運(yùn)用實施進(jìn)行具體地列舉剖析,做到理論與實踐操作相結(jié)合。
[Abstract]:Knowledge Process Outsourcing (KPO) is closely related to intellectual property as a knowledge-intensive industry. In our country, according to the investigation, the development of the knowledge process outsourcing industry is still in the primary state, and the intellectual property construction of the creative industry is not perfect. So this paper analyzes the subject of intellectual property rights in knowledge process outsourcing. This paper puts forward the authorization mode of intellectual property in KPO industry and the valuation system of various models to control the risk of intellectual property in knowledge process outsourcing. And through the investigation of knowledge process outsourcing industry-Yi Weishi China Business Consulting Co., Ltd. intellectual property licensing model was analyzed. Based on the research and analysis of intellectual property licensing model in KPO industry, this paper hopes to give reference to this emerging field. The key problems to be solved in this paper are as follows: the intellectual property risk of KPO and its control methods are put forward. Due to the existence of knowledge sharing between the supplier and the contractor in KPO, the supplier exposes its core technology and knowledge to its partners. This makes the knowledge process outsourcing may be faced with the loss of intellectual property rights, unfair distribution of intellectual property rights, unfair competition of intellectual property rights and exploitation of intellectual resources and other property rights risks. Through the analysis of the causes and mechanism of intellectual property risk in KPO, this paper divides intellectual property risk into intellectual property loss risk, third party intellectual property risk and intellectual property ownership risk. In the face of these risks, I put forward a series of control methods, in which the intellectual property licensing mode control mechanism in KPO is the most practical method to control risk. That is: unlimited authorization mode; pay-per-use mode according to actual use; capacity-on-demand authorization mode. Based on the selection of the authorization model, I have also proposed the corresponding: risk factor analysis, income factor analysis, adjustment and adaptability analysis and incentive strength analysis to assist KPO operators in their ability to adjust and adapt from risk, income, adjustment and adaptation. And incentive intensity and other aspects, analysis of the most suitable for their own authorization model. The first part introduces the concept category of KPO and the typical features of KPO which are different from other forms of outsourcing related to intellectual property. In the second part, the analysis basis and model can be used to identify the intellectual property risk in KPO, which makes the analysis results more accurate and persuasive. Combined with the case of Jiangtong Animation which I followed and investigated in the New Century Talent Project before, the main types of intellectual property involved in KPO were analyzed, and summarized to form the risk framework. The third part is to collect and summarize the typical analysis methods of our information management specialty, then extract the analysis model and method that can be used to identify the intellectual property risk in KPO, and make feasibility judgment, and then combine the above analysis method. Get the intellectual property risk in KPO. The fourth part is on the basis of putting forward the risk, combined with the research done by my mentor in the new century talent project in the whole year of last year, it is concluded that in addition to adopting the popular control method of the relevant intellectual property law, It is the most effective way of risk control in KPo to use the intellectual property licensing model and adopt reasonable intellectual property licensing mechanism. The last part is to use a typical example of domestic KPO enterprises which we have been tracking and investigating before, enumerating and analyzing the application of the above risk control model in enterprises, so as to combine theory with practice.
