【摘要】：本文針對(duì)作者與出版商簽訂的版權(quán)轉(zhuǎn)讓或排他性授權(quán)許可協(xié)議對(duì)IR收錄期刊論文的影響,立足現(xiàn)有著作權(quán)法規(guī),深入分析學(xué)術(shù)期刊的著作權(quán)問題,明確其整體著作權(quán)和局部作品著作權(quán)的權(quán)利歸屬。對(duì)國(guó)內(nèi)外期刊出版商的自存儲(chǔ)版權(quán)政策及政府資助研究成果的強(qiáng)制性開放存取政策進(jìn)行調(diào)查研究,提出通過機(jī)構(gòu)資助獲得出版商對(duì)機(jī)構(gòu)作品開放的整體授權(quán)、作者保留IR存儲(chǔ)作品的原有著作權(quán)、作者有權(quán)撤出IR已存儲(chǔ)作品等基于出版商版權(quán)政策的IR期刊論文存儲(chǔ)方案。
[Abstract]:In view of the influence of the copyright transfer or exclusive license agreement signed by the author and the publisher on the journal papers included in IR, this paper, based on the existing copyright laws and regulations, deeply analyzes the copyright problems of academic journals. Make clear its whole copyright and the right of partial work copyright belong to. This paper investigates and studies the self-storage copyright policy of periodical publishers at home and abroad and the compulsory open access policy of government-funded research results, and proposes to obtain the overall authorization of publishers to open their works to institutions through institutional funding. The author reserves the original copyright of the IR stored works, and the author has the right to withdraw the IR stored works and other IR periodical papers storage scheme based on the copyright policy of the publisher.
