在經(jīng)濟一體化和貿(mào)易自由化的進程中,隨著傳統(tǒng)關稅壁壘作用的逐漸削弱,以環(huán)境、人類和動物健康保護措施為特征的綠色貿(mào)易壁壘,已逐漸成為貿(mào)易保護的主要手段。綠色貿(mào)易壁壘涉及到具體的農(nóng)產(chǎn)品法律法規(guī),包括關貿(mào)總協(xié)定框架下和多邊貿(mào)易環(huán)境協(xié)定及本國環(huán)境條例中對其相關的法律制度規(guī)定。隨著貿(mào)易壁壘所具有的廣泛性、不平衡性以及歧視性特性的不斷強化,綠色貿(mào)易壁壘保障進口國家的經(jīng)濟利益、生態(tài)環(huán)境和資源的作用不斷凸顯,同時由于綠色貿(mào)易壁壘形式的合法性和內(nèi)容的廣泛性,使其越來越復雜,在對出口國家的利益構成威脅的同時,也使發(fā)展中國家在發(fā)展對外貿(mào)易時面臨新的困難。我國作為世界上最大的發(fā)展中國家,農(nóng)業(yè)是我國的傳統(tǒng)產(chǎn)業(yè),農(nóng)產(chǎn)品又是傳統(tǒng)的出口產(chǎn)品,綠色貿(mào)易壁壘之于我國農(nóng)產(chǎn)品的出口影響深遠。.自2001年加入WTO以來,中國的農(nóng)產(chǎn)品出口企業(yè)不僅受制于關稅、配額等限制,而且被所謂的“綠色要求”所限制,從而導致市場準入困難。在WTO的推動下,各國紛紛采取隱蔽性更強、透明度更低,更不易監(jiān)督和預測的綠色貿(mào)易壁壘對本國農(nóng)產(chǎn)品的生產(chǎn)和貿(mào)易加以保護,中國外貿(mào)農(nóng)產(chǎn)品和整個經(jīng)濟發(fā)展將會面對新的挑戰(zhàn),因而如何應對綠色貿(mào)易壁壘已成為我們要處理的關鍵...
