中國古代契約文書匯編研究

【摘要】：契約文書是指契約雙方在基層社會(huì)生活中發(fā)生一定權(quán)力義務(wù)關(guān)系時(shí),為保證訂立雙方的利益而形成的一種文書,諸如合同、協(xié)議書等。我國古代有大量的民間契約文書留世,契約文書是在各種社會(huì)活動(dòng)中直接產(chǎn)生的原始文字資料,生動(dòng)真實(shí)地記載了各個(gè)歷史時(shí)期社會(huì)經(jīng)濟(jì)、政治、文化和法律等方面的發(fā)展?fàn)顩r,具有原始性、唯一性,是當(dāng)時(shí)社會(huì)發(fā)展、民間百姓日常生活的真實(shí)再現(xiàn),作為非常珍貴的歷史檔案,具有重要的研究價(jià)值。20世紀(jì)80年代以來契約文書被廣泛發(fā)現(xiàn),其價(jià)值也日漸受到重視。各地區(qū)都有契約文書得以集中刊布并根據(jù)一定原則編輯成匯編并校審出版,至今已經(jīng)出版的契約文書匯編有百余部,但并未有學(xué)者對這些匯編進(jìn)行系統(tǒng)性的梳理分析,本文就以現(xiàn)出版的契約文書匯編為研究對象,對其進(jìn)行梳理匯總、分類整理,分析探討其形成的原則方法,總結(jié)其的特點(diǎn)規(guī)律。本文對中國古代契約文書匯編的研究主要從歷史沿革、編纂主體、編纂方法等方面進(jìn)行,具體分為五部分：第一部分縱觀古代契約文書匯編編纂的發(fā)展歷程,總結(jié)分析了不同時(shí)期契約文書匯編的編纂過程及特點(diǎn),并對一些具有標(biāo)志性意義的契約文書匯編進(jìn)行了重點(diǎn)說明和論述；第二部分對中國古代契約文書匯編的編纂主體分機(jī)構(gòu)與個(gè)人進(jìn)行分析介紹；第三部分對古代契約文書匯編按照收錄文書內(nèi)容、地點(diǎn)和出版方式進(jìn)行劃分,對不同類型的匯編進(jìn)行歸納總結(jié)；第四部分對現(xiàn)有契約文書匯編的編纂體例和編纂方法進(jìn)行了細(xì)致地歸納分析,以期對今后的編纂工作提供借鑒；第五部分對古代契約文書匯編進(jìn)行了特點(diǎn)和規(guī)律的總結(jié)分析,并對今后古代契約文書的編纂工作進(jìn)行展望�？傊�,本文是利用檔案文獻(xiàn)編纂學(xué)的相關(guān)理論,對現(xiàn)有古代契約文書匯編進(jìn)行的系統(tǒng)性、深入性匯總研究。
[Abstract]:Contract document refers to a kind of instrument, such as contract, agreement and so on, which is formed in order to ensure the interests of both parties when there is a certain power and obligation relationship between the two parties in the grass-roots social life. In ancient China, a large number of folk contractual documents survived. The contractual documents are the original written materials directly produced in various social activities, which vividly and truly record the development of social economy, politics, culture and law in each historical period, which is primitive and unique, and is the true reproduction of the daily life of the social development and the folk people at that time, as a very precious historical file. It has important research value. Since 1980 s, contractual documents have been widely found, and their value has been paid more and more attention. According to certain principles, there are more than 100 compilations of contractual documents that have been published so far, but no scholars have systematically combed and analyzed these compilations. This paper takes the currently published compendium of contractual documents as the research object, combs and aggregates them, classifies them, analyzes and discusses the principles and methods of their formation, and summarizes its characteristics and laws. This paper mainly studies the compilation of contract documents in ancient China from the aspects of historical evolution, compilation subject, compilation methods and so on, which is divided into five parts: the first part summarizes and analyzes the compilation process and characteristics of the compilation of contract documents in different periods, and focuses on some iconic compilation of contract documents. The second part analyzes and introduces the main body and individual of the compilation of ancient Chinese contractual documents; the third part divides the ancient compendium of contractual documents according to the content, place and publishing mode of the included documents, and summarizes the different types of compilations. The fourth part summarizes and analyzes the compilation style and methods of the existing compendium of contractual documents in detail, in order to provide reference for the compilation work in the future. The fifth part summarizes and analyzes the characteristics and laws of the compilation of ancient contractual documents, and looks forward to the compilation of ancient contractual documents in the future. In a word, this paper is a systematic and in-depth summary of the compilation of ancient contractual documents by using the relevant theories of archival literature compilation.
