【摘要】："小男當(dāng)戶(hù)"是指由"小男"擔(dān)任戶(hù)主,這樣的家庭被稱(chēng)為"小戶(hù)",唐前期"小戶(hù)"家庭并不少見(jiàn)。由于"小男"在法律上沒(méi)有獨(dú)立的行為能力,難以承擔(dān)作為"戶(hù)主"的一系列法律責(zé)任,因此,"小男當(dāng)戶(hù)"僅具有戶(hù)籍登記上的形式,不具有戶(hù)主的權(quán)力與責(zé)任。小戶(hù)有法定的受田額,但常常得不到保障,其依法享有的免除賦稅的特權(quán)也常被剝奪。
[Abstract]:" Small man " refers to " small man " as head of household , such family is called " small family " , " small family " family is not uncommon . As " small man " has no independent behavior ability in law , it is difficult to bear a series of legal responsibilities as " head of household " . Therefore , " small man " is only in the form of household registration , does not have the power and responsibility of the head of household .
