【摘要】：真實性是電子文件發(fā)揮憑證價值的核心要素,是國家記憶、社會記憶得以長期保存的重要前提和基礎(chǔ)。然而,由于電子文件具有易更改和不穩(wěn)定等特性,極易對電子文件進行不同程度的篡改、破壞,再加上觀念上的固化和管理的不完善,所以容易對電子文件的真實性產(chǎn)生質(zhì)疑。因此,為了維護真實的電子文件能夠行使法律效力,實現(xiàn)其憑證價值,筆者將本文的主要研究對象設(shè)定為電子文件真實性,通過歸納總結(jié)相關(guān)學者對電子文件真實性概念的認識,提出對這一概念范疇的界定,并通過與紙質(zhì)文件真實性的比較,總結(jié)出構(gòu)成電子文件真實性的憑證性要素,以及針對質(zhì)疑電子文件真實性的原因,筆者從法規(guī)制度、管理措施和技術(shù)保障三方面為維護電子文件真實性構(gòu)建一套保障體系。本文主要分為以下四個部分:第一部分是緒論部分,主要介紹選題的提出與意義,相關(guān)概念的界定,國內(nèi)外研究現(xiàn)狀以及本文的創(chuàng)新點和不足。第二部分,通過辨析真實性相關(guān)概念和分析電子文件與傳統(tǒng)紙質(zhì)文件真實性的區(qū)別,提煉出構(gòu)成電子文件真實性的憑證性要素。第三部分,主要從傳統(tǒng)觀念固化、信息技術(shù)上的障礙、管理上的障礙分析電子文件真實性受到質(zhì)疑的原因,從而為建立電子文件真實性的保障體系做鋪墊。第四部分,從法律制度建設(shè)、管理措施和技術(shù)保障三方面為維護電子文件真實性構(gòu)建完整的保障體系。
[Abstract]:Authenticity is the core factor for electronic documents to give full play to the value of documents. It is also an important premise and foundation for the long-term preservation of national memory and social memory.However, because electronic documents are easy to change and unstable, it is easy to tamper with and destroy electronic documents to varying degrees, and the concept of solidification and management is not perfect, so it is easy to question the authenticity of electronic documents.Therefore, in order to maintain the true electronic document can exercise the legal effect and realize its certificate value, the author sets the main research object of this paper as the authenticity of the electronic document.By summing up relevant scholars' understanding of the concept of electronic document authenticity, this paper puts forward the definition of this concept category, and through the comparison with the authenticity of paper document, summarizes the credential elements that constitute the authenticity of electronic document.Aiming at the reasons of questioning the authenticity of electronic documents, the author constructs a set of guarantee system from the aspects of legal system, management measures and technical support to maintain the authenticity of electronic documents.This paper is divided into the following four parts: the first part is the introduction part, mainly introduces the topics and significance, the definition of related concepts, domestic and foreign research status, as well as the innovative points and shortcomings of this paper.In the second part, by analyzing the related concepts of authenticity and analyzing the differences between electronic documents and traditional paper documents, the paper abstracts the evidential elements that constitute the authenticity of electronic documents.The third part, mainly from the traditional concept solidification, the information technology barrier, the management barrier analysis electronic document authenticity question reason, thus makes the foundation for the establishment electronic document authenticity safeguard system.The fourth part, from the legal system construction, the management measure and the technical guarantee three aspects constructs the complete safeguard system to safeguard the electronic document authenticity.
