【摘要】：電子資源已成為大學(xué)圖書館文獻資源建設(shè)的重要組成部分,而電子資源采購合同作為規(guī)定數(shù)據(jù)庫供應(yīng)商與圖書館雙方權(quán)利和義務(wù)的法律文件,具有重要作用。文章調(diào)研了現(xiàn)有中外文電子資源采購合同和招標采購合同的格式條款,分析其內(nèi)容特性和差異性,并在此基礎(chǔ)上對招標采購合同的格式和條款提出合理化建議,保障招標環(huán)境下高校電子資源的采購協(xié)議內(nèi)容的完備性,保護高校師生對于資源的使用權(quán)益。
[Abstract]:Electronic resources have become an important part of the construction of literature resources of university library, and electronic resources purchase contract as a supplier and library database provides both rights and obligations of the legal document, plays an important role. This paper investigates the existing foreign electronic resources purchase contract and bidding contract terms of format, analyze the content characteristics and differences, put forward reasonable suggestions in terms of format and bidding contract and on this basis, content of the electronic resources guarantee completeness of bidding under the environment of the purchase agreement, the protection of university teachers and students regarding resource use rights.
