【摘要】：圖書館法包括全國(guó)通用性、專類性和地區(qū)性三大類,其中地方圖書館法是圖書館法體系很重要的組成部分,地方圖書館法是指由地方立法機(jī)構(gòu)制訂并頒布的、用來調(diào)整圖書館活動(dòng)中產(chǎn)生的各種社會(huì)關(guān)系的法律規(guī)范的總和。由于各種因素影響,從新中國(guó)成立至今我國(guó)尚無一部由全國(guó)人民代表大會(huì)及其常務(wù)委員會(huì)制定或通過的具有統(tǒng)一法性質(zhì)的圖書館法,這無疑嚴(yán)重制約著我國(guó)圖書館事業(yè)的發(fā)展。不過值得慶幸的是,圖書館立法問題已經(jīng)引起國(guó)家和地方政府的注意,河南、浙江、北京、上海等部分省市率先制定了地方性的圖書館法規(guī)、政府規(guī)章,用以規(guī)范本地區(qū)圖書館事業(yè)的發(fā)展。對(duì)立法文件分析可以發(fā)現(xiàn),一方面我國(guó)地方圖書館立法工作起步雖晚,但起點(diǎn)較高,已頒布的法律內(nèi)容均較全面,特點(diǎn)鮮明;另一方面由于對(duì)立法工作的重要性認(rèn)識(shí)不足,地方圖書館立法成果數(shù)量不多,法律部分行文條款、措辭有待完善,質(zhì)量有待進(jìn)一步提高。 本文首先介紹國(guó)內(nèi)外關(guān)于中國(guó)地方圖書館立法的研究現(xiàn)狀,總結(jié)學(xué)術(shù)理論界在這方面取得的成果。其次,基于立法、地方立法、圖書館法的概念的界定,探討地方圖書館立法的內(nèi)涵、特征、形式和作用。再次,在詳細(xì)介紹我國(guó)地方圖書館立法現(xiàn)狀的基礎(chǔ)上,對(duì)現(xiàn)有的立法文件進(jìn)行對(duì)比,指出立法所取得的成績(jī),分析我國(guó)地方圖書館立法的存在的問題。最后,根據(jù)我國(guó)國(guó)情,針對(duì)地方圖書館立法中存在的問題,提出完善我國(guó)地方圖書館立法的若干對(duì)策,并對(duì)我國(guó)地方圖書館立法的發(fā)展趨勢(shì)進(jìn)行展望。
[Abstract]:The method includes national general, special and regional three categories, of which the local library law is an important part of library law system, the local library law is defined by the local legislature enacted and promulgated to legal norms of various social activities will have to adjust the library relationship. Due to various factors, there is not a library law that has been established or passed by the National People's Congress and its Standing Committee since the founding of new China. This undoubtedly seriously restricts the development of library cause in China. Fortunately, however, the issue of library legislation has attracted the attention of the state and local governments. Some provinces and municipalities such as Henan, Zhejiang, Beijing and Shanghai have taken the lead in formulating local library regulations and government regulations to regulate the development of the library industry in this area. On the legislative document analysis can be found, the initial legislative work of local libraries in China on the one hand, although late, but the starting point is high, the legal content have been issued are relatively comprehensive, distinctive characteristics; on the other hand, due to the importance of the legislative work of the lack of understanding of the local library legislation, achievement quantity is not much, part of the legal provisions, the wording should be perfect quality should be further improved.
