【摘要】：近年來世界范圍內(nèi)掀起了虛擬現(xiàn)實(shí)(Virtual Reality,以下簡稱VR)的研發(fā)熱潮,VR的應(yīng)用日益廣泛,大有取代PC等傳統(tǒng)信息平臺(tái)的趨勢。在這場研發(fā)熱潮中,我國企業(yè)憑借發(fā)達(dá)的互聯(lián)網(wǎng)產(chǎn)業(yè),在產(chǎn)品研發(fā)上,取得先機(jī),走在了世界的前列。但是我國企業(yè)普遍在VR技術(shù)的專利布局上存在缺陷,專利申請地域有限、行業(yè)有限等一系列專利問題日益成為我國VR企業(yè)走出去的最大障礙。本文從應(yīng)用型論文的角度出發(fā),通過對世界范圍內(nèi)VR技術(shù)檢索研究,結(jié)合我國國情,在法律和技術(shù)層面分析原因,對我國VR企業(yè)專利布局提出了改善意見。第一部分,描述并分析了本文的研究背景,得出VR技術(shù)的研發(fā)有助于我國在科技領(lǐng)域?qū)崿F(xiàn)彎道超車等結(jié)論,并對VR專利布局的研究現(xiàn)狀以及本文擬采用的研究方法進(jìn)行了綜述,從宏觀角度概括了本文的框架。第二部分,闡述VR的基本原理及其發(fā)展歷史,指出VR并非近年產(chǎn)生的新技術(shù),在上一個(gè)商業(yè)周期中,VR并未受到應(yīng)有的重視。對VR技術(shù)的特征進(jìn)行概括總結(jié),并對VR的技術(shù)構(gòu)成進(jìn)行分析,將VR技術(shù)進(jìn)行模塊化分解,得出VR技術(shù)可從宏觀角度分為立體顯示技術(shù)、數(shù)據(jù)處理技術(shù)以及3D處理與生成技術(shù)三個(gè)模塊。找出對應(yīng)的IPC分類小組,理清本文研究的切入點(diǎn),為后續(xù)專利檢索提供可靠依據(jù)。第三部分,通過VR行業(yè)專利分析找尋目標(biāo)企業(yè),為目標(biāo)企業(yè)的選定提供理論依據(jù),得出VR行業(yè)目前的推動(dòng)企業(yè)多為創(chuàng)業(yè)公司。隨后對VR專利的檢索方程式進(jìn)行構(gòu)建,界定研究范圍,獲取準(zhǔn)確的專利數(shù)據(jù)信息。對該信息進(jìn)行申請時(shí)間分析,獲取VR技術(shù)的研發(fā)周期,判斷現(xiàn)階段VR技術(shù)研發(fā)特點(diǎn),得出現(xiàn)階段正是VR研發(fā)的高峰時(shí)期;對該信息進(jìn)行地域分析,得出世界范圍內(nèi)VR分布概況以及不同國家和地區(qū)對VR技術(shù)的重視程度;對該信息進(jìn)行申請人分析,明確VR領(lǐng)域的具體競爭企業(yè)。對以上分析的結(jié)論做出總結(jié),尋找目標(biāo)企業(yè),有針對性地對目標(biāo)企業(yè)進(jìn)行專利布局研究。第四部分,對國內(nèi)外VR重點(diǎn)企業(yè)進(jìn)行分析,在企業(yè)專利布局特點(diǎn)上得出國外企業(yè)偏向于3D生成技術(shù)以及數(shù)據(jù)處理技術(shù)的專利布局,國內(nèi)企業(yè)偏向于立體顯示技術(shù)的專利布局等結(jié)論,在防范專利侵權(quán)的策略上得出國外企業(yè)采用專利預(yù)警等方法防范專利侵權(quán)風(fēng)險(xiǎn)而國內(nèi)企業(yè)則很少有專利侵權(quán)防范措施等結(jié)論。其中在年度分析和地域分析的基礎(chǔ)上引入專利的技術(shù)領(lǐng)域分析,探究企業(yè)在基礎(chǔ)技術(shù)模塊之外的專利布局,找出不同企業(yè)的研發(fā)重點(diǎn),更為全面地對重點(diǎn)企業(yè)VR技術(shù)的專利布局進(jìn)行研究,從而為下文專利布局提供依據(jù)。結(jié)論部分,根據(jù)上文總結(jié)的國內(nèi)外重點(diǎn)企業(yè)專利布局特點(diǎn),結(jié)合我國VR研發(fā)現(xiàn)狀,從進(jìn)攻和防守層面對VR專利布局提供建議,提出即便在VR技術(shù)中已經(jīng)被對手廣泛布局的領(lǐng)域,仍然存在通過專利的交叉許可等方式打破對手壟斷從而進(jìn)入相關(guān)市場的可能。并認(rèn)為我國企業(yè)需提高專利的國際布局意識(shí),提高自身研發(fā)能力,積極搶占國際市場。此外在其他布局建議中,主要從減少專利布局成本的角度出發(fā),提出構(gòu)建高校合作實(shí)驗(yàn)室、利用國內(nèi)各個(gè)省市的專利優(yōu)惠政策等策略。
[Abstract]:In recent years the world launched a virtual reality (Virtual Reality, hereinafter referred to as VR) the upsurge of research and development, VR has been widely used, much to replace the traditional information platform PC trend. In this research upsurge, the enterprises of our country with developed Internet industry, made the initiative on product research and development, and walk in the forefront of the world. However, Chinese enterprises generally in VR technology patent layout defects, patent application industry Co., limited territory, and a series of patent issues has become the biggest obstacle to China's VR enterprises to go out. This paper from the application point of view, through the study of the world within the scope of VR retrieval. According to the situation of our country, analysis of the reasons in the legal and technical aspects of the VR enterprise patent layout in our country and puts forward the improvement suggestion. The first part describes and analyzes the research background, research shows that VR technology is helpful to our country Conclusion to achieve corner overtaking in the field of science and technology, and the VR patent layout research status and the research methods to be adopted are reviewed, from a macro perspective summarizes the frame of this paper. The second part, the basic principle and development history of VR, pointed out that the new technology is not in the VR, in a business cycle in VR, has not received due attention. The features of VR technology are summarized, and the analysis of VR technology, VR technology will be modular decomposition, the VR technology can be from a macro point of view is divided into three modules of stereo display technology, data processing technology, 3D processing and classification to find IPC generation technology. For the time analysis of the information acquisition, VR technology research and development cycle, to judge the present VR technology development characteristics, present stage is VR during the peak period of development of the information; geographical analysis, that of VR distribution in the world and in different countries and regions of the VR degree of attention to the information of the applicant; analysis, clear field of VR specific competitors. To make a summary of the conclusions of the above analysis, to find the target enterprise, the research on the patent layout of the target enterprise. In the fourth part, analysis of the domestic and foreign VR key enterprises, in the characteristics of business patent layout that foreign enterprises tend to 3D generation technology and data processing technology With the layout of the patent, domestic enterprises in favor of stereoscopic display technology patent layout etc. conclusion, in the prevention of patent infringement on the strategy of foreign enterprises that use patent early warning methods to prevent the risk of patent infringement and domestic enterprises are few conclusion patent infringement prevention measures. The conclusion part, according to the key enterprises at home and abroad patent layout features summarized above, combined with the status quo of VR research and development in China, from attack and defense in providing advice VR patent layout, put forward even in the VR technology has been widely opponents of the field layout, still Through the way of patent cross licensing monopoly to break the opponent to enter the relevant market. And that Chinese enterprises need to improve the international awareness of patent layout, improve its research and development capabilities, to seize the international market actively. In addition to other layout suggestions, mainly from the perspective of cost reducing patent layout, put forward the construction of cooperation laboratory in Colleges and universities.
