【摘要】：專利確權(quán)指針對專利權(quán)這一權(quán)利是否存在或者是否有效的問題,由有權(quán)機關(guān)作出的權(quán)威性意見,這種權(quán)威性意見常以行政決定或司法判決的形式出現(xiàn)。專利制度的宗旨是鼓勵發(fā)明創(chuàng)造,但如果沒有對專利權(quán)是否存在或者是否有效的判斷確認機制,那么專利制度將無法發(fā)揮其作用,也就形同虛設。我國由行政機關(guān)專利局對一項符合規(guī)定的專利申請作出授予專利權(quán)的通知;對于已經(jīng)授予的專利權(quán),由專利復審委員會作出宣告專利權(quán)無效審查決定來確定該項專利權(quán)是否有效。 本文共分為三個部分:引言、正文和結(jié)論。 引言部分介紹了本文的研究目的。 正文部分共分五章。第一章介紹了專利確權(quán)制度的基本概念、價值等;第二章介紹了我國專利確權(quán)的基本模式,即授予專利權(quán)程序及宣告專利權(quán)無效程序;第三章介紹了與專利確權(quán)有關(guān)的相關(guān)制度,并分析這些制度對于我國專利確權(quán)產(chǎn)生的影響;第四章介紹了外國專利確權(quán)制度的基本狀況并對各國制度進行了評析;第五章探討了我國專利確權(quán)制度中存在的問題,并給出了建議方案。 結(jié)論部分總結(jié)了全文并提出了建議。
[Abstract]:Patent confirmation right refers to the existence or validity of the right of patent right, which is often in the form of administrative decision or judicial decision. The purpose of patent system is to encourage invention and creation, but if there is no mechanism to judge whether the patent right exists or is effective, then the patent system will not play its role. In China, the Patent Office of an administrative organ shall give notice of the grant of a patent right to a patent application that meets the requirements; for a patent that has already been granted, The patent review board shall make a decision to invalidate the patent right to determine whether the patent right is valid or not. This paper is divided into three parts: introduction, text and conclusion. The introduction introduces the purpose of this paper. The text is divided into five chapters. The first chapter introduces the basic concept and value of patent confirmation right system, the second chapter introduces the basic mode of patent confirmation right in China, that is, the procedure of granting patent right and declaring patent right invalid. The third chapter introduces the relevant systems related to patent confirmation rights, and analyzes the impact of these systems on patent confirmation rights in China, the fourth chapter introduces the basic status of foreign patent confirmation rights system and analyzes the national systems. The fifth chapter discusses the existing problems in the patent confirmation system in China, and gives some suggestions. The conclusion part summarizes the full text and puts forward some suggestions.
