【摘要】：行政指導(dǎo)以自身所具有的民主性、互動(dòng)性、協(xié)商性和可自由選擇性成為當(dāng)下實(shí)現(xiàn)行政法治目標(biāo)的重要途徑。由于行政指導(dǎo)行為具有較大的自由裁量空間,加之行政指導(dǎo)主體天然的公權(quán)力背景,難以保證每一個(gè)實(shí)施行政指導(dǎo)行為的行政主體都能恰如其分地對(duì)自身的行政權(quán)力進(jìn)行自我規(guī)制,為了防止行政相對(duì)人的合法權(quán)益受到損害,有必要對(duì)行政指導(dǎo)主體進(jìn)行必要的規(guī)制。行政自我規(guī)制能力是從行政系統(tǒng)內(nèi)部出發(fā),以行政主體自身為規(guī)制的出發(fā)點(diǎn)和落腳點(diǎn),以行政主體自身所具有的專(zhuān)業(yè)理性和內(nèi)在理性能力,指導(dǎo)行政主體進(jìn)行正確的行政動(dòng)機(jī)選擇,準(zhǔn)確把握與行政相對(duì)人之間的行政法律關(guān)系;積極主動(dòng)地監(jiān)督和約束自身的行政權(quán)力和行政行為;及時(shí)總結(jié)和糾正在行政指導(dǎo)實(shí)踐中出現(xiàn)的問(wèn)題,并自覺(jué)加以改進(jìn)的能力,行政主體具備的這種內(nèi)在理性能力對(duì)于引導(dǎo)行政主體合法合理實(shí)施行政指導(dǎo)行為具有積極的意義。綜觀目前我國(guó)行政指導(dǎo)主體在實(shí)踐中運(yùn)用行政自我規(guī)制能力的現(xiàn)實(shí)情況,還存在行政主體無(wú)法正確認(rèn)識(shí)與行政相對(duì)人之間的行政法律關(guān)系性質(zhì),不能及時(shí)準(zhǔn)確地定位自身的行政角色;行政系統(tǒng)內(nèi)部對(duì)于行政指導(dǎo)主體的激勵(lì)機(jī)制還有待完善;監(jiān)督行政指導(dǎo)行為的行政法律制度設(shè)計(jì)不夠健全和規(guī)范;行政主體對(duì)行政指導(dǎo)實(shí)踐當(dāng)中存在的問(wèn)題不能及時(shí)總結(jié)和改進(jìn)等問(wèn)題。因此有必要加強(qiáng)行政主體對(duì)自我規(guī)制的理念和行政指導(dǎo)的認(rèn)識(shí),以提升行政指導(dǎo)主體的動(dòng)機(jī)選擇和角色定位能力;健全行政系統(tǒng)內(nèi)部監(jiān)督制度,以提高行政指導(dǎo)主體的自我監(jiān)察能力;健全行政系統(tǒng)內(nèi)部激勵(lì)機(jī)制,以提升行政指導(dǎo)主體的自我糾正及改進(jìn)能力;積極接受行政外部監(jiān)督規(guī)制,以從外部進(jìn)一步提升行政指導(dǎo)主體的行政自我規(guī)制能力。
[Abstract]:Administrative guidance with its own democratic, interactive, consultative and free choice is an important way to realize the goal of administrative rule of law. Because the administrative guidance behavior has the larger discretion space, in addition to the administrative guidance subject's natural public power background, It is difficult to ensure that every administrative subject who carries out administrative guidance can properly regulate their own administrative power, in order to prevent the legitimate rights and interests of administrative counterpart from being damaged, It is necessary to regulate the subject of administrative guidance. The ability of administrative self-regulation starts from inside the administrative system, regards the administrative subject itself as the starting point and the end point of the regulation, and takes the professional rationality and the internal rational ability of the administrative subject as its own. Guiding the administrative subject to make the correct choice of the administrative motive and accurately grasping the administrative legal relationship between the administrative counterpart and the administrative subject; To actively supervise and restrain their own administrative power and behavior; Summarizing and correcting the problems in the practice of administrative guidance in time, and consciously improving the ability, the administrative subject has this inherent rational ability to guide the administrative subject to carry out the administrative guidance behavior legally and reasonably has the positive significance. In view of the fact that the administrative guidance subject in our country uses the administrative self-regulation ability in practice, there still exists the nature of the administrative legal relationship between the administrative subject and the administrative counterpart, which can not be correctly understood by the administrative subject. Unable to locate their own administrative role in time and accurately; The internal incentive mechanism of administrative guidance subject is still to be perfected, the administrative legal system to supervise the administrative guidance behavior is not perfect and standard; The problems existing in the practice of administrative guidance cannot be summed up and improved in time. Therefore, it is necessary to strengthen the administrative subject's understanding of the concept of self-regulation and administrative guidance, in order to enhance the ability of motivation choice and role orientation of the administrative guidance subject; Improve the internal supervision system of the administrative system in order to improve the self-supervision ability of the main body of administrative guidance, improve the internal incentive mechanism of the administrative system, in order to enhance the self-correction and improvement ability of the main body of the administrative guidance; To actively accept the administrative external supervision and regulation in order to further enhance the administrative self-regulation ability of the administrative guidance subject from the outside.
