【摘要】： 志愿服務(wù)是指任何人自愿貢獻(xiàn)個(gè)人時(shí)間和精力,在不為物質(zhì)報(bào)酬的提下,為推動(dòng)人類發(fā)展、社會(huì)進(jìn)步和社會(huì)福利事業(yè)而提供的服務(wù)。志愿服務(wù)作為一種高尚的社會(huì)行為和一項(xiàng)重要的社會(huì)公益事業(yè),在彌補(bǔ)我國(guó)社會(huì)保障,維護(hù)社會(huì)安全穩(wěn)定,促進(jìn)青年社會(huì)化,服務(wù)經(jīng)濟(jì)建設(shè)與社會(huì)道德構(gòu)建等方面發(fā)揮了積極作用,對(duì)于構(gòu)建社會(huì)主義和諧社會(huì),推進(jìn)人類進(jìn)步具有重要意義。但是,目前我國(guó)志愿者權(quán)益保護(hù)還面臨很多問題,如志愿服務(wù)的法制不夠健全、志愿服務(wù)社會(huì)認(rèn)知度不高、志愿組織建設(shè)不夠,志愿者與服務(wù)對(duì)象之間的關(guān)系不明確等問題,嚴(yán)重制約著我國(guó)志愿服務(wù)的發(fā)展。本文立足于我國(guó)志愿者活動(dòng)發(fā)展現(xiàn)狀結(jié)合現(xiàn)行行政體制,借鑒國(guó)外經(jīng)驗(yàn),運(yùn)用實(shí)證分析與規(guī)范分析相結(jié)合、歸納方法與演繹方法相結(jié)合、比較分析法。在總結(jié)我國(guó)志愿者權(quán)益保護(hù)現(xiàn)狀及問題的基礎(chǔ)上,對(duì)完善我國(guó)志愿者權(quán)益保護(hù)相關(guān)法律制度提出一些構(gòu)想。 本文除引言外,共分為四章和結(jié)語。 引言部分主要提出論文研究的背景和意義。開篇提出了本文研究的背景,然后論述了在目前情況下,針對(duì)我國(guó)目前志愿者權(quán)益保護(hù)存在問題提出對(duì)策的必要性。 第一章是主要分析我國(guó)志愿者權(quán)益保護(hù)現(xiàn)狀及存在的問題。通過比較國(guó)外在志愿者保護(hù)現(xiàn)狀及成功經(jīng)驗(yàn)的梳理和分析,指出了我國(guó)目前在志愿者權(quán)益保護(hù)方面存在的問題:第一,缺乏可操作性的法律法規(guī);第二,志愿者與服務(wù)對(duì)象之間的關(guān)系不明確,志愿者權(quán)利不夠具體;第三,志愿者權(quán)利救濟(jì)方面缺乏必要的物質(zhì)保障;第四,社會(huì)上對(duì)志愿者不理解、不支持的現(xiàn)象比較嚴(yán)重。第五,志愿者組織缺乏對(duì)志愿者權(quán)益保護(hù)意識(shí)。本章通過和國(guó)外成熟的志愿者權(quán)益保護(hù)對(duì)比提出我國(guó)志愿者權(quán)益保護(hù)存在的問題,為后面部分的論述提供對(duì)策方向。 第二章針對(duì)我國(guó)志愿者權(quán)益保護(hù)存在的問題,從法理學(xué)的角度對(duì)我國(guó)志愿服務(wù)活動(dòng)的的法律屬性進(jìn)行分析。為后面章節(jié)的提出具體的對(duì)策提供了法理的依據(jù)。在本章中,首先論述了志愿服務(wù)的法律特征,法律構(gòu)成要件。然后對(duì)志愿服務(wù)的主體志愿者及志愿者組織進(jìn)行法律定位分析。最后對(duì)志愿服務(wù)的法律關(guān)系進(jìn)行了分析,主要包括志愿者與志愿者組織的法律關(guān)系,志愿者與服務(wù)對(duì)象的法律關(guān)系以及志愿者與服務(wù)對(duì)象以外人的法律關(guān)系。 第三章主要針對(duì)我國(guó)志愿者權(quán)益保護(hù)存在的立法問題進(jìn)行分析,針對(duì)我國(guó)目前志愿服務(wù)立法松散,統(tǒng)一性不強(qiáng)等特點(diǎn)進(jìn)行分析,并提出相應(yīng)的立法建議。首先,從目前我國(guó)關(guān)于志愿者立法的現(xiàn)狀依據(jù)據(jù)目前國(guó)內(nèi)22個(gè)省市的關(guān)于志愿服務(wù)的地方性立法,對(duì)志愿者立法的框架進(jìn)行歸納分析。其次,針對(duì)國(guó)內(nèi)立法的歸納分析,從立法理論進(jìn)行評(píng)析。最后,依據(jù)以上的志愿服務(wù)法理分析,針對(duì)國(guó)內(nèi)目前立法體例并借鑒國(guó)外成功經(jīng)驗(yàn)提出立法對(duì)策和建議。 第四章主要針對(duì)第一章分析的志愿者權(quán)益保護(hù)問題除立法之外的問題進(jìn)行歸類提出對(duì)策。首先,借鑒國(guó)外的實(shí)踐經(jīng)驗(yàn),倡導(dǎo)津貼志愿者,完善志愿者激勵(lì)法律制度。其次,針對(duì)志愿者組織對(duì)志愿者權(quán)益保護(hù)意識(shí)不夠,提出應(yīng)完善志愿者組織相關(guān)法律制度。最后,針對(duì)志愿者權(quán)益物質(zhì)保障不充分,建議把志愿服務(wù)納入社會(huì)保障體系,完善志愿者的人身保險(xiǎn)制度。 在結(jié)語部分,對(duì)全文的論述作了簡(jiǎn)短的總結(jié),提出我國(guó)應(yīng)當(dāng)加強(qiáng)我國(guó)志愿者權(quán)益保護(hù)相關(guān)法律制度的建設(shè)。
[Abstract]:Voluntary service refers to any person who voluntarily contributes to personal time and energy and provides services for the promotion of human development, social progress and social welfare without material remuneration. Volunteering serves as a noble social behavior and an important social public welfare undertaking to make up for our social security and maintain social security and stability. It has played an active role in promoting the socialization of youth, serving economic construction and building social morality. It is of great significance for building a socialist harmonious society and promoting human progress. However, the protection of the rights and interests of volunteers in our country is still faced with many problems, such as the lack of sound legal system and the social awareness of voluntary service. High, voluntary organization construction is not enough, the relationship between volunteers and service objects is not clear and so on, which seriously restricts the development of voluntary service in China. This article is based on the present situation of the development of volunteer activities in China, combining with the current administrative system, drawing on the experience of foreign countries, combining empirical analysis with normative analysis, and summarizing the methods and deductive methods. On the basis of summarizing the status and problems of the protection of the volunteers' rights and interests in China, some ideas are put forward to improve the legal system of the protection of the rights and interests of volunteers in our country.
In addition to the introduction, this article is divided into four chapters and conclusion.
In the introduction, the background and significance of the research are put forward. The background of this paper is put forward, and then the necessity of putting forward the countermeasures against the present problems of the protection of the rights and interests of volunteers in our country is discussed.
The first chapter is the main analysis of the status and existing problems of the protection of volunteers' rights and interests in China. Through the comparison of the status and the successful experience of the volunteer protection in foreign countries, this paper points out the existing problems in the protection of volunteers' rights and interests in our country: first, the lack of operable laws and regulations; second, between the volunteers and the service objects. The relationship is not clear, the volunteers' rights are not specific enough; third, the volunteer rights relief is lack of necessary material security; fourth, the social volunteers do not understand, and the non support phenomenon is more serious. Fifth, the volunteer organization lacks the awareness of the protection of the volunteers' rights and interests. This chapter compares with the protection of the mature volunteers' rights and interests abroad. The problems existing in the protection of volunteers' rights and interests in China will provide some countermeasures for the later discussion.
The second chapter, in view of the problems existing in the protection of the rights and interests of volunteers in China, analyzes the legal attributes of voluntary service activities in our country from the perspective of jurisprudence. It provides a legal basis for the specific countermeasures of the later chapters. In this chapter, the legal characteristics of voluntary service, the constitutive requirements of the law, and the voluntary service are first discussed. The legal relationship between the volunteers and the volunteer organizations was analyzed. Finally, the legal relationship of volunteer service was analyzed, including the legal relationship between volunteers and volunteer organizations, the legal relationship between volunteers and service objects, and the legal relationship between volunteers and people outside the service object.
The third chapter mainly analyzes the legislative issues of the protection of volunteers' rights and interests in China, analyzes the characteristics of our country's current voluntary service legislation loose and ununified, and puts forward the corresponding legislative proposals. First, the present situation of the volunteer legislation in China is based on the voluntary service in 22 provinces and cities at present. Local legislation, the framework of the voluntary legislation is summarized and analyzed. Secondly, in view of the induction and analysis of domestic legislation, it is evaluated from the legislative theory. Finally, according to the analysis of the legal theory of voluntary service above, the legislative measures and suggestions are put forward in view of the current legislative body in China and the successful experience of foreign countries.
The fourth chapter mainly aims at the problem of the protection of volunteers' rights and interests analysis in the first chapter, and puts forward the Countermeasures in addition to the problems other than the legislation. First, draw on the practice experience of foreign countries, advocate the subsidy volunteers and improve the volunteer incentive legal system. Secondly, the volunteer organization should improve the volunteers' rights and interests protection, and propose to perfect the volunteer group. In the end, it is suggested that voluntary service should be incorporated into the social security system in order to improve the personal insurance system of volunteers.
In the concluding part, a brief summary of the full text is made, and it is suggested that China should strengthen the construction of relevant legal system for the protection of the rights and interests of volunteers in China.
