【摘要】：我國《刑法》規(guī)定了容留他人吸毒罪,在吸毒行為不構(gòu)成犯罪的情形下,對于“幫助”吸食毒品的活動予以刑法上的規(guī)制,這有利于打擊各類毒品活動,對于營造良好的社會風(fēng)氣,保障公民的身心健康有著積極意義。但在司法實踐中,由于對“容留”的理解過于淺顯,在種類繁多的吸毒活動中如何認定行為人是否實施了容留行為依舊不乏爭議。對于“容留”的認定有必要予以系統(tǒng)闡述。實踐中,對于容留的認定主要考慮的是數(shù)量因素,忽視了對容留行為本身的探討,一些不存在現(xiàn)實危害性的行為可能被認定為犯罪,有擴張刑罰權(quán)的趨勢。從保護公民自由與法益的現(xiàn)實需要出發(fā),對容留行為的認定需要從客觀方面予以限制。容留他人吸毒罪中的“容留”,是指為他人吸食毒品而提供場所或便利的行為,是對違法行為的一種幫助。行為人主觀上必須是直接的故意,對于自身行為所造成的后果需有明確認識。為他人吸食毒品提供場所或便利的行為,只能以積極作為的方式實施,不存在不作為犯罪。容留的具體表現(xiàn)方式,主要是提供場所和提供便利。在對提供場所行為進行認定時,要重點明確場所的封閉性和現(xiàn)實可控性特點。行為人現(xiàn)實占用場所時即具有對場所的控制權(quán),控制權(quán)的認定是提供場所行為的前提。在多個控制權(quán)并存的情況下,對他人吸食毒品活動有實質(zhì)幫助的行為才是容留。在對提供便利行為進行認定時,要明確的是并不是所有的幫助行為都屬于“便利”,在提供便利的方式上需要予以限制,以防止不當(dāng)擴大刑法處罰范圍。
[Abstract]:The Criminal Law of our country provides for the crime of accommodating others to take drugs. If drug abuse does not constitute a crime, the criminal law will regulate the activities of "helping" drug users, which is conducive to cracking down on all kinds of drug activities. To create a good social atmosphere, to protect the physical and mental health of citizens has a positive significance. However, in the judicial practice, because the understanding of "accommodation" is too simple, there are still many controversies on how to determine whether the perpetrator has carried out the sheltering behavior in various kinds of drug abuse activities. It is necessary to explain systematically the determination of "accommodation". In practice, the determination of shelter is mainly considered by the quantity factor, ignoring the discussion of the sheltering behavior itself, and some behaviors which do not exist the realistic harmfulness may be considered as crimes and have the tendency of expanding the penalty right. In order to protect civil liberties and legal interests, the determination of accommodation needs to be restricted objectively. In the crime of taking drugs by others, "accommodation" refers to the act of providing a place or convenience for others to take drugs, and it is a kind of help to the illegal behavior. The actor must be directly intentional subjectively, and must have a clear understanding of the consequences of his own behavior. The act of providing a place or convenience for others to take drugs can only be carried out in a positive manner, and there is no crime of omission. The specific expression of accommodation, mainly to provide a place and provide convenience. When identifying the behavior of providing place, we should focus on the characteristics of closure and reality controllability. When the actor occupies the place in reality, he has the control right to the place, and the recognition of the right of control is the premise of providing the behavior of the place. In the case of multiple control, the behavior that actually helps others with drug use is sheltered. In determining the act of providing convenience, it should be made clear that not all aiding acts belong to "convenience" and need to be restricted in the way of providing convenience in order to prevent improper expansion of the scope of criminal punishment.
