【摘要】：危險駕駛行為在未受刑法調(diào)整之前,對危險駕駛行為的處罰都是采取民事、行政手段,但威懾力不大。隨著惡性交通事故頻發(fā)和全民呼聲高漲,危險駕駛行為于2011年2月25日通過的《刑法修正案(八)》新增入罪,經(jīng)過《刑法修正案(九)》的修改,初步對危險駕駛行為有了刑法上的含義,本罪現(xiàn)共有四個類型的犯罪,即追逐競駛型、醉酒型、超速超載型、違規(guī)運輸化學(xué)品型。但本罪入罪后,因是新入刑法調(diào)整的罪名,因此在司法實踐中存在很多疑難問題,筆者作為一名審判人員,深感實踐中對本罪名的審理中存在一些問題,從刑法立法上來說不可能詳細一一闡明。因此筆者想通過本文對危險駕駛四個類型犯罪做詳細解釋和分析,并對審理四個類型案件過程中發(fā)現(xiàn)的疑難事宜予以探討,本著為刑法理論提供參考的出發(fā)點,從司法實踐中的疑難問題入手,詳細探討在司法實踐過程中所產(chǎn)生的相關(guān)問題,以及對這些問題的一些學(xué)術(shù)上的觀點,并就筆者所在的地區(qū)為例具體分析實踐中審判時面對這些疑難問題的解決辦法。文章首先對危險駕駛四個標(biāo)準(zhǔn)類型逐一分析,介紹各類型的含義,并通過對國內(nèi)外關(guān)于危險駕駛行為的規(guī)定,分析我國危險駕駛?cè)胱锏木唧w情形和存在的問題,并且提出自己的建議和觀點。而后文章通過提出問題、解答問題的方式,針對在司法實踐中審理四個類型犯罪存在的難點問題,詳細闡明并且歸納總結(jié),提出筆者自身對于疑難問題的解決辦法。在詳細分析四大類型的危險駕駛罪具體含義后,再從各類型犯罪的疑難問題上分析,最后分析本罪與其他罪名競合時疑難問題的解決,以及發(fā)生附帶民事訴訟時的具體解決方式。通過本文的解答,筆者對很多司法實踐中的疑難問題都查閱資料做出了規(guī)范性的解釋,并且針對此問題的諸多學(xué)者的觀點也在文章中有所體現(xiàn),希望通過本文對司法機關(guān)實踐理解和實際審理危險駕駛罪名有一定的幫助,同時也希望通過本文給立法提供依據(jù)和事實基礎(chǔ),以期望對我國的法律完善貢獻法律人一份微薄之力。
[Abstract]:Before the dangerous driving behavior is adjusted by criminal law, the punishment of dangerous driving behavior is civil and administrative, but the deterrent force is not big. With the frequent occurrence of malignant traffic accidents and the rising voices of the whole people, the dangerous driving behavior was added to the criminal law amendment (8) adopted on February 25, 2011, which was amended by the Criminal Law Amendment (9). There are four types of crimes in this crime, that is, chasing race driving, drunken, overloading and transporting chemicals illegally. But after this crime is incriminated, because it is the new criminal law adjustment, so there are many difficult problems in the judicial practice. As a judge, the author deeply feels that there are some problems in the trial of this crime in practice. From the criminal law legislation can not be elaborated in detail. Therefore, the author would like to explain and analyze the four types of dangerous driving crimes in detail through this article, and discuss the difficult matters found in the trial of the four types of cases, in order to provide the starting point for the theory of criminal law. Starting with the difficult problems in judicial practice, this paper discusses in detail the related problems arising in the course of judicial practice, as well as some academic viewpoints on these problems. As an example, the author analyzes the solutions to these difficult problems in practice. The article first analyzes the four standard types of dangerous driving one by one, introduces the meaning of each type, and through the domestic and foreign regulations on dangerous driving behavior, analyzes the specific situation and existing problems of the criminalization of dangerous driving in China. And put forward their own suggestions and views. Then through the way of putting forward questions and answering questions, aiming at the difficult problems existing in the trial of four types of crimes in judicial practice, this paper expounds and summarizes them in detail, and puts forward some solutions to the difficult problems. After the detailed analysis of the specific meanings of the four major types of dangerous driving crime, the paper analyzes the difficult problems of each type of crime, and finally analyzes the solution of the difficult problems when the crime is competing with other charges. And the concrete solution when the incidental civil action occurs. Through the solution of this paper, the author has made a normative explanation to many difficult questions in judicial practice, and the views of many scholars on this question are also reflected in the article. It is hoped that this paper will help the judicial authorities to understand and actually try the charges of dangerous driving in practice, and at the same time, it also hopes to provide the basis and factual basis for the legislation through this article. In the hope of improving the law of our country to contribute a modest contribution to the law.
