【摘要】：音樂作品著作權(quán)許可制度是音樂作品著作權(quán)人行使音樂作品著作權(quán)行為的保障,其為音樂作品著作權(quán)人實現(xiàn)其音樂作品著作財產(chǎn)權(quán)利獲得報酬提供了渠道,同時滿足了音樂作品使用人對音樂作品的使用,對平衡音樂作品著作權(quán)人使用人利益、促進(jìn)音樂作品傳播起著十分重要的作用。而隨著互聯(lián)網(wǎng)技術(shù)的發(fā)展以及網(wǎng)絡(luò)的普及,雖然方便了音樂作品使用人使用、擴(kuò)大了音樂作品傳播范圍及影響范圍,但是對傳統(tǒng)音樂作品著作權(quán)許可制度帶來了一定的沖擊,給音樂作品著作權(quán)人合法利益造成了一定的損害,本文針對網(wǎng)絡(luò)環(huán)境下對音樂作品著作權(quán)許可制度的影響,分析我國音樂作品著作權(quán)許可制度中存在的不足之處,借鑒國外網(wǎng)絡(luò)環(huán)境下音樂作品著作權(quán)許可制度的有益經(jīng)驗,對《著作權(quán)法修改草案》的修訂意見進(jìn)行評析,并在此基礎(chǔ)上提出完善我國音樂作品著作權(quán)許可制度的建議,更好的面對網(wǎng)絡(luò)環(huán)境下對音樂作品著作權(quán)許可制度的沖擊,保護(hù)音樂作品著作權(quán)的合法利益。
[Abstract]:The copyright licensing system of music works is the guarantee for the copyright holders of music works to exercise the copyright of music works, which provides a channel for the copyright owners of music works to realize the property rights of their music works and obtain remuneration. At the same time, it satisfies the use of music works by users, and plays an important role in balancing the interests of users of music works and promoting the dissemination of music works. With the development of the Internet technology and the popularization of the network, although it facilitates the users of music works and expands the scope of dissemination and influence of music works, it has a certain impact on the copyright licensing system of traditional music works. This paper aims at the influence of the network environment on the copyright licensing system of music works, and analyzes the shortcomings of the copyright licensing system of music works in our country. Based on the beneficial experience of the copyright licensing system of music works in foreign countries, this paper comments on the revision opinions of the revised draft of copyright Law, and puts forward some suggestions to perfect the copyright licensing system of music works in China. Better to face the impact on the copyright licensing system of music works under the network environment, to protect the legitimate interests of music copyright.
