【摘要】： 隨著全球環(huán)保意識的不斷提高,濕地所具有的獨(dú)一無二的生態(tài)價(jià)值和經(jīng)濟(jì)價(jià)值越來越受到人們的關(guān)注,通過完善的法律對濕地加以保護(hù)的呼聲也越來越高。我國目前沒有專門的濕地立法,濕地的保護(hù)尚依賴傳統(tǒng)的資源法,面對我國濕地不斷減少的現(xiàn)狀,盡快進(jìn)行專門的濕地保護(hù)立法迫在眉睫。本文通過對保護(hù)濕地的國際公約以及對發(fā)達(dá)國家如美國、澳大利亞濕地保護(hù)立法經(jīng)驗(yàn)的介紹,為我國濕地保護(hù)的立法提出具體而有可操作性的建議。 全文共分為四個(gè)部分: 第一部分介紹了濕地的概況和價(jià)值。首先分析了各國對濕地的定義以及濕地所具有的特殊生態(tài)價(jià)值和經(jīng)濟(jì)價(jià)值,然后介紹了濕地不斷喪失的現(xiàn)狀以及保護(hù)濕地的緊迫性和重要性。 第二部分介紹了《濕地公約》對濕地的保護(hù)。首先介紹了《濕地公約》締約國所承擔(dān)了三大義務(wù),其次重點(diǎn)介紹了《濕地公約》促進(jìn)締約國保護(hù)濕地的理念和手段,最后對公約的作用加以總結(jié)。 第三部分介紹發(fā)達(dá)國家濕地保護(hù)的立法和政策。該部分介紹了美國和澳大利亞的濕地保護(hù)經(jīng)驗(yàn)以及值得借鑒之處,詳細(xì)介紹了美國聯(lián)邦濕地立法的理念以及機(jī)構(gòu)協(xié)調(diào)和利益權(quán)衡機(jī)制,澳大利亞的國家濕地政策以及各州完備的公眾參與制度。 第四部分就我國濕地保護(hù)立法的現(xiàn)狀提出我國濕地保護(hù)立法的幾點(diǎn)建議。具體來說分為四個(gè)方面,首先應(yīng)制定專門的濕地保護(hù)立法,其次應(yīng)確立保護(hù)性利用的濕地保護(hù)的理念,再次構(gòu)建良好的公眾參與的制度,最后協(xié)調(diào)濕地保護(hù)管理機(jī)構(gòu)的職能。
[Abstract]:With the increasing awareness of global environmental protection, people pay more and more attention to the unique ecological value and economic value of wetland. At present, there is no special wetland legislation in our country, and the protection of wetland still depends on the traditional resource law. In the face of the declining situation of wetland in our country, it is urgent to carry out special wetland protection legislation as soon as possible. Based on the introduction of the international conventions on wetland protection and the experience of developed countries such as the United States and Australia, this paper puts forward concrete and operable suggestions for the legislation of wetland protection in China. The full text is divided into four parts: The first part introduces the general situation and value of wetland. Firstly, the definition of wetland and its special ecological and economic value are analyzed. Then, the status quo of wetland loss and the urgency and importance of wetland protection are introduced. The second part introduces the protection of Wetlands by the Convention on Wetlands. This paper first introduces the three obligations of the parties to the Convention on Wetlands, then emphasizes on the concept and means of promoting the protection of wetlands in the States parties of the Convention, and finally summarizes the role of the Convention. The third part introduces the legislation and policy of wetland protection in developed countries. This part introduces the experience of wetland conservation in the United States and Australia and its merits, and introduces in detail the concept of the United States federal wetland legislation and the mechanism of institutional coordination and balancing of interests. Australia's National Wetland Policy and state system of public participation. The fourth part puts forward some suggestions on the legislation of wetland protection in China. Specifically, it is divided into four aspects: firstly, special wetland protection legislation should be formulated; secondly, the concept of conservation wetland protection should be established, and then a good system of public participation should be established, finally, the functions of wetland protection management agencies should be coordinated.
