【摘要】：從世界各個主要發(fā)達國家來看,刑事訴訟中的庭前程序包含著兩個子程序,一個是庭前審查程序,也叫公訴審查程序,一個是庭前準(zhǔn)備程序;前者主要為了限制檢察機關(guān)的不當(dāng)起訴和保障犯罪嫌疑人的人權(quán),而后者主要為了保障訴訟的順利展開以及訴訟的效率。雖然我國的2012年《刑事訴訟法》完善了一些刑事庭前程序的內(nèi)容,但是其中庭前準(zhǔn)備程序的內(nèi)容遠遠多于庭前審查程序的內(nèi)容,且規(guī)定的庭前審查程序也只做程序性審查,這就使庭前審查程序的功能打了折扣,甚至于說根本就沒有起到作用。隨著我國十八屆四中全會做出的全面推進依法治國若干重大問題的決定,以審判為中心的刑事訴訟制度改革也躍然紙上,其中重要的就是改革庭前審查程序。因為只有庭前審查程序的優(yōu)化,才能真正保障審判的中心地位,而不至于讓審判流于形式化。所以筆者嘗試通過比較國外相關(guān)制度的方法來對我國刑事訴訟中的庭前審查程序進行初步研究,并期望在結(jié)合我國國情和現(xiàn)有制度的情況下,能設(shè)計出一些有效的措施來優(yōu)化我國刑事庭前程序中的審查程序。本文共分四個部分。第一部分是對刑事庭前審查程序的概述,主要是對其概念、特征、內(nèi)容、功能、目的的敘述。第二部分是對我國刑事庭前審查程序現(xiàn)狀的描述,通過其中得出一些問題。第三部分是對世界幾個發(fā)達國家的刑事庭前審查的制度的介紹,然后通過評析其制度來得出啟示。第四部分就是在對我國制度現(xiàn)狀及其問題的分析基礎(chǔ)上,給出解決的思路以及改革的措施,讓我國的刑事庭前審查程序也發(fā)揮其應(yīng)有的功能。
[Abstract]:From the major developed countries in the world, the pretrial procedure in criminal proceedings contains two subroutines, one is the pretrial review procedure, also known as the public prosecution review procedure, and the other is the pretrial preparation procedure; The former mainly aims to limit the prosecution by procuratorial organs and to protect the human rights of criminal suspects, while the latter is mainly to ensure the smooth development of the proceedings and the efficiency of the proceedings. Although our country's Criminal procedure Law in 2012 has perfected the content of some criminal pretrial procedure, but the content of pretrial preparation procedure is much more than that of pretrial review procedure, and the prescribed pretrial review procedure only does procedural review. This makes the pre-trial review process less functional, or even ineffective. With the decision made by the fourth Plenary session of the 18th Central Committee of our country to comprehensively promote the administration of the country by law, the reform of the criminal procedure system centered on trial has also jumped to paper, among which the important one is to reform the pretrial examination procedure. Only through the optimization of the pretrial review procedure can the central position of the trial be ensured and the trial be formalized. Therefore, the author tries to make a preliminary study on the pretrial review procedure in criminal proceedings in China by comparing the relevant foreign systems, and expects that under the condition of combining the national conditions and the existing system of our country, Some effective measures can be designed to optimize the review procedure in the criminal pretrial procedure in China. This paper is divided into four parts. The first part is an overview of the pretrial review procedure, including its concept, characteristics, content, function and purpose. The second part is the description of the present situation of the pretrial review procedure in China, through which some problems are found. The third part is the introduction of the system of criminal trial review in several developed countries, and then through the evaluation of its system to draw inspiration. The fourth part is on the basis of the analysis of the present situation and problems of our country's system, gives the solution thought and the reform measure, lets our country's criminal pretrial examination procedure also play its due function.
